<br />subsequent seeking of the same remedy for other damages or otherwise, whether available <br />hereunder or existing at law or in equity. No waiver of any breach of any covenant, condition or <br />agreement herein contained shall operate as a waiver of any subsequent breach thereof. No <br />payment by Tenant or receipt by Landlord of a lesser amount than the monthly rent installment <br />due shall be deemed to be other than on account of the earliest rent due. Landlord may accept <br />such check or payment without prejudice to Landlord's right to recover the balance of such rent <br />or to pursue any other remedy provided in this Lease. Any endorsement or statement on any <br />check or letter accompanying a check for payment of rent shall not be deemed an accord and <br />satisfaction unless so stated in writing by Landlord. No re-entry of Landlord, and no acceptance <br />by Landlord of keys from Tenant, shall be considered an acceptance of a surrender of the Lease, <br />unless so stated in writing by Landlord. <br /> <br />21. QUIET ENJOYMENT <br /> <br />Landlord warrants that it has the right to lease the Leased Premises and that so long as <br />Tenant shall perform each and every term, condition and covenant to be performed and observed <br />by Tenant hereunder, Tenant shall have peaceful and quiet use and possession of the Leased <br />Premises without hindrance on the part of Landlord. <br /> <br />22. SHORT-FORM LEASE <br /> <br />Each party hereto agrees that it shall, upon the request of the other given at any time <br />during the term of this Lease, execute, acknowledge and deliver to the other a short form of lease <br />meeting the requirements of the laws of the State of Minnesota in recordable form. Preparation <br />and recording shall be done by Landlord and charges therefor, as well as for documentary stamps <br />or like tax, shall be paid for by the requesting party. The ternlS of such short form, if executed, <br />shall constitute a part of this Lease as though recited herein. <br /> <br />23. RECORDING <br /> <br />Tenant shall not record this Lease without prior consent of the Landlord. <br /> <br />24. NOTIFICATION <br /> <br />Any notice required or permitted to be given by any party upon the other is given in <br />accordance with this Agreement if it is directed to Seller by delivering it personally to an officer <br />of Seller, or if it is directed to Buyer, by delivering it personally to an officer of Buyer, or if <br />mailed in a sealed wrapper by United States registered or certified mail, return receipt requested, <br />postage prepaid, or if deposited cost paid with a nationally recognized, reputable overnight <br />courier, properly addressed as follows: <br /> <br />If to Seller: City of Ramsey <br />7550 Sunwood Drive N.W. <br />Ramsey, MN 55303 <br />Attn: City Administrator <br /> <br />13 <br />
