CASE # 1 <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW FOR INDOOR RETAIL <br />SALES OF MOTOR VEHICLES AT 13915 RADIUM ST NW IN THE E -1 DISTRICT: <br />CASE OF COMPLETE MOTOR SPORTS <br />By: Chris Anderson, Environmental Coordinator <br />Background: <br />Complete Motor Sports would like to sell scooters, kids' four - wheelers and dirt bikes to the public <br />from one of the suites in the building located at 13915 Radium St NW. The site is zoned E -1 <br />Employment, which requires a Conditional Use Permit to conduct indoor retail sales. <br />Notification: <br />State statute requires notification of the public hearing to property owners within 350 feet of the subject <br />property. Staff sent out notices to all property owners within 350 feet. <br />Observations: <br />Complete Motor Sports would like to utilize a unit in Business Park 95 .to sell scooters, kids' four - <br />wheelers and dirt bikes to the public. They would utilize newspapers and fairs to market their product <br />and use the Ramsey location for customers to pick up their new scooters. They would also have a <br />small indoor show floor area to display their product for sale to the public. The show floor space <br />would include about 20 units at any given time. There likely would also be a small amount of <br />accessories for sale, such as helmets and clothing. The hours of operation would likely be Monday <br />through Friday from 8:00- 4:30pm. <br />The sale of scooters requires a Dealer License Certificate issued by the MN Department of Public <br />Safety (Driver and Vehicle Services Division). Prior to the issuance of this certificate, the City must <br />indicate whether the proposed use is a permitted or conditional use and if a conditional use, whether <br />there is a valid permit on file, which is what prompted this request for a conditional use permit. <br />The entire site is paved and there appears to be adequate parking for this type of use. City Code <br />stipulates that there shall be at least 1 parking space for each 200 square feet of floor space; the <br />proposed use would have roughly 800 square feet of show floor space. Thus, a minimum of 4 stalls <br />would be necessary. There are a total of 102 parking stalls for this multitenant building. <br />The E -1 District states that indoor retail, rental or service activity may be allowed as a conditional use <br />if the following criteria are met: <br />1. The use meets the stated intent of the E -1 District. <br />2. Adequate off - street parking and off - street loading is provided in accordance with Chapter 9 of <br />City Code. <br />3. All signing and informational or visual communication devices comply with the provisions set <br />forth in City Code. <br />4. The provisions of Chapter 9.03.05 Subd. 2. g are considered and satisfactorily met. <br />
