Motion by Councilmember Elvig, seconded by Councilmember Dehen, to approve Resolution <br />#09 -06 -120, supporting the application for Transportation Enhancement funds for the <br />Mississippi River Trail, connecting Anoka and Ramsey. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Dehen, Jeffrey, Look, and <br />Wise. Voting No: None. Absent: Councilmember McGlone. <br />Case #5c Approve Contract for Sedimentation Basin Improvements and Partnerships <br />for Mississippi West Regional Park <br />Councilmember McGlone returned to the Council Chambers at 8:15 p.m. <br />Parks Supervisor Riverblood reviewed the staff report and some of the details in the contract. <br />Councilmember Look asked if this organization has submitted references or if Parks Supervisor <br />Riverblood knows where they have done work before. <br />Parks Supervisor Riverblood stated that they have a great reputation of using citizen groups for <br />conservation work and noted that he has been following their work for about ten years. <br />Councilmember Look asked if there is any assurance that this project will be done, for example, <br />if the volunteer work force is not there. He expressed concern about possible liability issues and <br />injuries that may occur with a volunteer work force. <br />Parks Supervisor Riverblood stated that they have planned for 100 volunteers and expect 80 to <br />show up. He stated that he doesn't feel this should be a concern. He noted that he can modify <br />the contract for indemnification, if the Council would like. He noted that this is County Park <br />property and noted that the volunteers will only be using hand tools. <br />Councilmember McGlone asked about liability issues and how this differs from other <br />subcontractors the City uses. He stated that he feels the City needs to be covered in this <br />situation. <br />City Attorney Goodrich suggested on page 5, paragraph IV, adding the reverse terms for an <br />additional paragraph so the City is also held harmless and also to make sure the City is named as <br />an additional insured parry. <br />Motion by Mayor Ramsey, seconded by Councilmember Look, to make an amendment to the <br />language in the contract with Great River Greening on page 5, IV, adding the statement that <br />Greening will indemnify the City of Ramsey and hold it harmless from and against any loss, <br />claims, liabilities, damages and costs, including reasonable attorney's fees, related to the Project <br />of the performance of their services pursuant to this Agreement, unless caused by the negligence <br />of the City of Ramsey, its agents or employees; and that the City by named as an additional <br />insured party. <br />City Council / June 9, 2009 <br />Page 9 of 14 <br />
