<br />Motion by Mayor Ramsey, seconded by CouncilmemberMcGlone to Adopt a Resolution to <br />approve a three-month extension to Summerset Meadows, LLC, to submit the final plat <br />application for the Summerset Meadows subdivision. <br /> <br />Further Discussion: Councilmember Look stated that wouldn't allow time for the applicant to <br />determine if they can gift the City the right of way, as discussed. Councilmember Elvig <br />suggested tabling this to allow time to check with the owners on the right-of-way issue. <br />Associate Planner Gladhill stated that staff would support tabling this, as well, as long as the City <br />can meet the 60-day action rule. Councilmember Look stated that he feels tabling is a better <br />option because it gives the applicant an incentive towards working together with the City on this <br />Issue. <br /> <br />Motion and second withdrawn by Mayor Ramsey and Councilmember McGlone. <br /> <br />City Attorney Goodrich stated that because the Council doesn't meet until June 23, it would not <br />meet the60-day requirement and suggested approving the 3-month extension. <br /> <br />Councilmember Look suggested approving 3-month extension, pending the approval of right-of- <br />way gifting. <br /> <br />City Attorney Goodrich stated that he doesn't think those two items should be connected and the <br />Council should respond to the applicant's request. <br /> <br />Motion by Councilmember Elvig, seconded by Mayor Ramsey, to Adopt Resolution #09-06-117 <br />to approve a 30-day extension to Summerset Meadows, LLC, to submit the final plat application <br />for the Summerset Meadows subdivision. <br /> <br />Further Discussion: Public Works Olson noted that the Preliminary Plat goes with the property. <br />Councilmember Look expressed concern that there is no guarantee that the City would receive <br />the right-of-way. Councilmember Dehen stated that he is in favor of giving them a three-month <br />extension. Councilmember Elvig stated that his intent with the 30-day extension was to move <br />this along to meet the 60-day requirement and feels the City has a "captive ear" right now. <br />Community Development Director Miller noted that the Council needs to take action tonight to <br />meet the 60-day requirement for action. <br /> <br />Motion carried. V oting Yes: Mayor Ramsey, Councilmembers Elvig, Dehen, Jeffrey, Look, <br />McGlone, and Wise. '! oting No: None. <br /> <br />Case #2: <br /> <br />Request for a Conditional Use Permit to Allow for Motor Vehicle Sales n the <br />E-1 District: Case of Diamond Auto, Inc. <br /> <br />Community Development Director Miller reviewed the staff report. She noted that staff is <br />recommending approval of the request.
