Motion by Councilmember Elvig, seconded by Councilmember Dehen, to approve Resolution #09-06-120, supporting the application for Transportation Enhancement funds for the Mississippi River Trail, connecting Anoka and Ramsey. Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Dehen, Jeffrey, Look, and Wise. Voting No: None. Absent: Councilmember McGlone. Case #5: Approve Contract for Sedimentation Basin Improvements and Partnerships for Mississippi West Regional Park Councilmember McGlone returned to the Council Chambers at 8:15 p.m. Parks Supervisor Riverblood reviewed the staff report and some of the details in the contract. Councilmember Look asked if this organization has submitted references or if Parks Supervisor Riverblood knows where they have done work before. . Parks Supervisor Riverblood stated that they have a great reputation of using citizen groups for conservation work and noted that he has been following their work for about ten years. Councilmember Look asked if there is any assurance that this project will be done, for example, if the volunteer work force is not there. He expressed concern about possible liability issues and injuries that may occur with a volunteer work force. Parks Supervisor Riverblood stated that they have planned for 100 volunteers and expect 80 to show up. He stated that he doesn't feel this should be a concern. He noted that he can modify the contract for indemnification, if the Council would like. He noted that this is County Park property and noted that the volunteers will only be using hand tools. Councilmember McGlone asked about liability issues and how this differs from other subcontractors the City uses. He stated that he feels the City needs to be covered in this situation. City Attorney Goodrich suggested on page 5, paragraph IV, adding the reverse terms for an additional paragraph so the City is also held harmless and also to make sure the City is named as an additional insured party. Motion by Mayor Ramsey, seconded by Councilmember Look, to make an amendment to the language in the contract with Great River Greening on page 5, IV, adding the statement that Greening will indemnify the City of Ramsey and hold it harmless from and against any loss, claims, liabilities, damages and costs, including reasonable attorney's fees, related to the Project of the performance of their services pursuant to this Agreement, unless caused by the negligence of the City of Ramsey, its agents or employees; and that the City by named as an additional insured party.
