I.,' ~

MDNR Shoreland and Floodplain

D. Bach plan must identify member local units or government that have failed to adopt and
administer a MDNR-approved shoreland andfloodplain ordinance where mandated by
state law. If the plan notes that flood damage has occurred outside of mapped
floodplains or a potential for flooding exists adjacent to stormwater facilities, the plan
shall require the local unit of government to determine if additional local controls are
necessary to address the situation.

Table 6 shows the status of each member community as it relates to MDNR Shoreland and
Floodplain ordinances.

Table 6

Shoreland and Floodplain Ordinances

City / < Shoreland Floodplain
..... > .
Coon Rapids x x
Andover x x
Anoka x x
Ramsey x x

Land Use

E. If a plan notes the existence of certain land uses that could adversely affect the
organization's ability to achieve its water quality goals, and these uses'cannot be
properly managed or regulated with existing controls, the uses constitute a public
nuisance according to MinnesotaStatutes, Section 609.74. In those cases, the plan must
provide for the adoption of local controls to define and abate the nuisances. For the
purpose of this chapter, public nuisance may include any action, failure to act, or land
use practice that would impair water quality if allowed to continue.

Any change in land use from the zoning at the time of adoption of this plan that covers 1 acre or
more must be approved by all municipalities in the subwatershed where the change is to occur.

Notification of intent to change land use and all pertinent information shall be given to the
representative of the affected city twenty-one (21) days before the zoning change is to take place.
, Upon receipt, approval or rejection shall be made within 21 days. If no response is made, approval
wilI be implied. If the change is rejected within the specified time limit, an acceptable solution
should be attempted by all municipalities in the subwatershed. If no solution is reached, the
municipality desiring change may bring the matter to the WMO for decision as outlined in the Joint
Powers Agreement.

Water Management Plan
P:\Mpls\23 MN\02\2302047\WorkFiles\3rd Gen WMP\LRRWMO_3rd Gen WMP _July 2009_Draft.doc

77
