<br />6. That the permanent confinement area must be contiguous to the residence, and enclosed by a <br />permanent fence able to physically confine all dogs under the ownership of the Permittee. <br /> <br />7. That the permanent confinement area must meet or exceed any relevant sections of the <br />Ramsey City Code, and must be constructed on the Subject Property no later than April <br />30th 2009. <br /> <br />8. That until the permanent fence, enclosing the permanent confmement area, is constructed, all <br />dogs under the ownership of the Permittee must be restrained at all times when outside of <br />the residence or when outside of the existing kennel by use of a leash secured in-hand of the <br />Permittee or designee of the same. <br /> <br />9. That the Permittee shall be responsible for obtaining all applicable permits including a <br />zoning permit to construct a permanent fence. <br /> <br />10. That this Permit shall not give the Permittee authority or permission to conduct commercial <br />kennel activities on the Subject Property, including but not limited to breeding, selling <br />training, grooming or boarding. <br /> <br />11. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />12. That the Permittee shall be responsible for City costs incurred in administering and <br />enforcing this Permit. <br /> <br />13. That in the event a dog is removed from the Subject Property, no replacement dog will, <br />except upon a fmding by the City, that there have been no complaints of neighbors objecting <br />to the dogs on the Subject Property, which complaint is substantiated by the City. <br /> <br />14. That in the event there is a substantiated complaint, the City will conduct an additional <br />public hearing in accordance with the City's conditional use permit process to determine <br />whether a fourth dog should be permitted on the Subject Property. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Elvig, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Look <br />Councilmember Elvig <br />Councilmember Dehen <br />Councilmember Olson <br />Councilmember Strommen <br /> <br />RESOLUTION #08-11-231 <br />Page 2 of 4 <br />
