<br />Board Member Nixt stated his observation is that the Board of Adjustment has a properly <br />convened meeting, which the City Attorney has commented on, and the Council is well aware of <br />vacancies existing and unless Council took action timely, the Board of Adjustment is in a <br />position where in accordance with past practice, the Board would appoint a Chair and Vice Chair <br />at this time. He suggested if the current Board of Adjustment feels it has individuals it would <br />recommend for the open seats who are present this evening and are currently serving and could <br />fulfill the role, then the Board should take action accordingly; if not, the Board of Adjustment <br />should table this item. <br /> <br />Board Member Cleveland stated it was her opinion that no action has currently been taken by the <br />Council because work sessions are not formal meetings and no formal action can be taken at <br />work sessions. She added as the Board of Adjustment, we come forward as voting members and <br />felt the Board should decide if it wants to nominate a Chair and Vice Chair or wait until next <br />month. <br /> <br />Board Member Rogers stated he felt the Board of Adjustment should get clarity on the issue <br />before moving. forward and wait until next month. <br /> <br />Chairperson VanScoy asked about timing on the final resolution ofthis matter. <br /> <br />Community Development Director Miller stated it was her understanding that administration is <br />drafting a policy for consideration at the next Council meeting on January 13 and that policy <br />would reappoint board and commission members. She noted at this time, the policy will just <br />appoint Councilmembers to those boards and commissions and will not reappoint existing <br />commission members. She added Council plans to move forward with the interview process and <br />notifying those board and commission members whose terms are expiring, and Council hopes to <br />wrap it all up by the end of March. <br /> <br />Ex officio Board Member Brauer stated it seems everything is still in limbo and he assumed this <br />would be taken care of already and one way or another, the commission would be seated. He <br />added it may cause problems if no commissions are seated until March. <br /> <br />Board Member Nixt stated the Board of Adjustment is currently short a full panel of members <br />and as a routine order of business, the Board appoints a Chair and Vice Chair at its first meeting <br />of the year. He indicated he was okay with deferring this appointment until the next meeting <br />until there is a full slate of board members. <br /> <br />Community Development Director Miller stated she did not think there would be a problem with <br />the appointment of a Chair and Vice Chair as long as neither position is filled by one of the ex <br />officio members. <br /> <br />Chairperson Van Scoy stated the timing of the change in policy is disconcerting and is impacting <br />the Board's ability to do its work. <br /> <br />Motion by Chairperson VanScoy, seconded by Board Member Nixt, to table the appointment of <br />a Chair and Vice Chair of the Board of Adjustment for 2009. <br /> <br />Board of Adjustment/January 8,2009 <br />Page 3 of7 <br />
