<br />1. map and describe within a one thousand foot radius (1,000') of the <br />proposed WECS the topography, existing residences and location of <br />their windows, locations of other structures, wind speeds and <br />directions, existing vegetation and roadways. The model shall <br />represent the most probable scenarios of wind constancy, sunshine <br />constancy, and wind directions and speed. <br /> <br />2. calculate the locations of shadow flicker caused by the proposed <br />project and the expected duration of the flicker at these locations, <br />and calculate the total number of hours per year of flicker at all <br />locations. <br /> <br />3. identify problem areas where shadow flicker will interfere with <br />existing or future residences and roadways and describe proposed <br />mitigation measures, including, but not limited to, a change in site <br />selections of the WECS, a change in the operation of the WECS, or <br />grading or landscaping mitigation measures. <br /> <br />c. Written documentation from the U.s. Fish and Wildlife Service or applicable <br />government agency, documenting that the proposed site will not interfere <br />with migratory bird patterns. <br /> <br />d. Before the issuance of a building permit, the following supplemental <br />information shall be submitted: <br /> <br />1. Affirmation that the proposed WECS will comply with any applicable <br />regulations administered by the Federal Aviation Administration, and <br /> <br />2. A report from a qualified and licensed professional engineer which <br />demonstrates the compliance of the WECS with the aforementioned <br />structUral and electrical (but not radio frequency) standards. <br />a. Electrical standards are set by State Statue/Law and inspected <br />by the State Electrical Inspector. <br /> <br />3. Certificate of insurance for the WECS. <br /> <br />9.17.19 Conditional Use Permit Required. Except as otherwise provided for in this Section of <br />the Code, it shall be unlawful for any person, firm, or corporation to erect, construct in place, <br />place or re-erect, or replace any WECS without first making application to the City Council and <br />securing a conditional use permit therefore as hereinafter provided. Routine maintenance of the <br />WECS and related structures shall not require the issuance of a conditional use permit. <br /> <br />9.17.20 Violations. Any person who shall violate any of the provisions of this Section shall be <br />guilty of a misdemeanor. . <br /> <br />9.17.21 Existing WECS. Any WECS in existence as of the effective date of this Ordinance, <br />which do not conform to or comply with this Section of the Code are subject to the following <br />provlslons: <br />
