Councilmember Dehen asked if there is any potential liability if the City does not proceed with the partial acquisition. City Attorney Goodrich stated it appears that there is not a written agreement in place and thus, there is no valid cause of action. The Council discussed the history of this project and the site plan review undertaken by the City. Public Works Director Olson stated that staff has engaged the property owner about possibly relocating but the property owner has indicated he is unable to do so. Coupcilmember Look stated that case #3 was an amendment to the cost-sharing agreement with ACRRA for the final design of the rail station. He indicated the City Council previously authorized an additional $150,000 for a total of $300,000 to complete the final design of the Ramsey Rail Station. He stated that since then, Kimley Horn learned that its estimate was understated and has revised its estimate to $357,000. He indicated that of the original $174,268 preliminary design contract, $37,000 remains, so a total of $320,000 needs to be funded, or an additional $10,000 from the City and $10,000 from the Anoka County Rail Authority; the Finance Committee voted to recommend approval of this additional amount. Motion by Councilmember Look, seconded by Councilmember Dehen, to approve the Report from the Finance Committee and take the following action: Adopt Resolution #09-08-196 authorizing proposal from Northland Strategies for strategic financial planning proposal in an amount not to exceed $13,600; Postpone the partial acquisition of Lot 1, Block 1, Alpaca Estates pending completion of the preliminary design for the Armstrong Boulevard interchange; to amend the cost sharing amount approved in Resolution #Q9-06-122 authorizing a cost sharing amount with ACRRA for final design for the Northstar Commuter Rail station in Ramsey at a cost not to exceed $160,000 utilizing the Landfill Trust Fund. Motion carried. V oting Yes: Mayor Ramsey, Councilmembers Look, Dehen, Elvig, McGlone, and Wise. Voting No: None. Absent: Councilmember Jeffrey. Case #12: Introduce Ordinance to Add City Code Section 9.17 to Permit Wind Energy Conversion Systems as a Conditional Use; Case of the City of Ramsey Associate Planner Gladhill stated this case introduces an ordinance for wind energy conversion systems; staffhas been working under a moratorium of these types of requests. Councilmember Wise stated he thought it was redundant and counter-productive to put a wind generator ordinance in place when it comes to setbacks of one and one-half times the height of the tower and 1,000 feet from any adjacent residential unit. He stated he felt this was exorbitant and most cities are not doing that type of setback. Associate Planner Gladhill indicated that part of this whole process was the public input process and research shows that noise and shadow flicker all the primary concerns and those concerns appear to be mitigated once the structure is beyond 1,000 feet from any residence.
