<br />Steve Rudd, a neighbor, stated his concern is the back up alarm during the night and the number <br />of times it is used during the night. <br /> <br />Scott Grams, 16450 Nowthen Blvd., the applicant, stated he does take into consideration the <br />noise the back up alarms make and his trucks have a disabling switch for the back up alarm. His <br />night tows average three a month. He stated he could extend the driveway to park the trucks <br />back behind the house line for screening compliance. He will have at the most two trucks on the <br />property. He will continue to run one of the vehicles all night. <br /> <br />Discussion ensued as to where the trucks could be parked on the driveway and still be in <br />compliance with City Code. <br /> <br />Commissioner Dunaway asked how long the business has been run out of the home. Mr. Grams <br />stated three and one half years. <br /> <br />Commissioner VanScoy asked if the new vehicle will be better at starting as one of the concerns <br />is that the trucks are running all night. <br /> <br />Mr. Grams stated he doesn't run them all night, the new diesels have plug in heaters. They do <br />have to run five to ten minutes when you start them up. <br /> <br />Motion by Chairperson Levine, seconded by Commissioner Van Scoy, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners, Van Scoy, Cleveland, <br />Dunaway, Hunt, and Rogers. Voting No: None. Absent: None. <br /> <br />The public hearing closed at 8:39 p.m. <br /> <br />Commission Business <br /> <br />Discussion ensued on complaints and how they can be addressed. <br /> <br />Motion by Commissioner Cleveland, seconded by Commissioner Hunt, to recommend City <br />Council adopt the findings of fact favorable relating to the applicant's request for a home <br />occupation permit. <br /> <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Cleveland, Hunt, Dunaway, <br />Rogers, and Van Scoy. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Cleveland, seconded by Commissioner Van Scoy, to recommend that <br />the City Council approve the applicant's request for a home occupation permit to operate a tow <br />and recovery business on the property located at 16450 Nowthen Blvd. with an amendment to #6 <br />to read as follows "That a Zoning Permit will need to be issued for the parking area, as it will be <br />upgraded to class V, concrete or bituminous as stated in section 9.11.08 of City Code with both <br />vehicles being parked even or behind the principal dwelling", and based on the findings of fact. <br /> <br />Planning Commission/August 6, 2009 <br />Page 5 of 12 <br />
