Attachment B <br />Councilmember <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION #09-Q9-_ <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST <br />FROM ERIC AND JAMIE TOPERO FOR A CONDITIONAL USE PERMIT FOR A <br />PRIVATE DOG KENNEL TO MAINTAIN FOUR OR MORE DOGS ON A PARCEL OF <br />PROPERTY. <br />WHEREAS, the City ofRamsey received an application from Eric and Jamie Topero for <br />a conditional use permit to maintain more than three dogs on the property generally known as <br />6738 153rd Lane NW, and legally described as follows: <br />The west 135 feet of the east 2478.76 feet (as measured along south line) of the <br />south 323 feet of the south half of the northeast quarter of Section 22, Township 32, <br />Range 25, except road subject to easement of record, Anoka County, Minnesota. <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESQTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That City Code Section 5.03.09 allows a maximum of three dogs per parcel. <br />2. That Section 5.09.03 of the Ramsey City Code defines private dog kennels as any place <br />where four or more dogs over six (6) months of age on property occupied by the dog owner <br />for residential purposes and where the keeping of such dogs in incidental to the occupancy of <br />the premises, and may include breeding and selling dogs as a hobby. <br />3. That private kennels are a conditional use per City Code Section 9.20.11 <br />4. That on August '1 1, 2009, Eric and Jamie Topero, hereinafter referred to as "Applicants", <br />properly applied for a conditional use permit for a private dog kennel to maintain four or <br />more dogs on the Subject Property. <br />5. That the applicants appeared before the Ramsey Plannirig Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on September 3, 2009; and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />6. That the Subject Property is zoned R-1 Rural Developing. <br />7. That the adjacent properties are also zoned R-1 Rural Developing. <br />8. That the Subject Property is approximately 0.90 acres in size. <br />9. That the Subject Property is currently owned by Joshua J. and Jennifer M. Kidd. <br />
