<br />Councilmember Wise introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-08-187 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0850 RELATING TO A <br />REQUEST FROM ANATOLIY AND ZINAIDA LOGINOV FOR A HOME <br />OCCUPATION PERMIT TO OPERATE A MOTOR VEHICLE REPAIR SERVICE ON <br />THE PROPERTY LOCATED AT 6830 150TH LN NW. <br /> <br />WHEREAS, the City of Ramsey received an application from Anatoliy and Zinaida <br />Loginov requesting a home occupation permit to operate a motor vehicle repair service in an <br />accessory structure located on the property generally known as 6830 I 50th Ave NW and legally <br />described as follows: <br /> <br />Lot 4, Block 3, Peltzer Addition, Subject to Easement as Shown On Plat <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That on June 11, 2009, Anatoliy and Zinaida Loginov, hereinafter referred to as <br />"Applicant", properly applied for an accessory structure home occupation permit (the <br />"Permit") to operate a motor vehicle repair service on the Subject Property. <br /> <br />2. That on March 16, 2009, the City received an Ordinance Complaint regarding the <br />operation of a motor vehicle repair and body shop as well as a siding business on the <br />Subject Property. <br /> <br />3. That on March 17,2009, the City inspected the Subject Property and found indications <br />of auto body repair including indications of body work and painting being operated on the <br />Subject Property. In addition, several Inoperable Vehicles, as defined by City Code, <br />were found behind a screened area on the Subject Property. The Applicant was issued <br />a notice to terminate all automotive repair activities due to concerns with hazardous <br />materials. <br /> <br />4. That home occupations proposing to include operations relating to motor vehicle repairs <br />shall be processed in accordance with procedures established for Conditional Use <br />Permits. <br /> <br />5. That on June 16, 2008, the City Council adopted a home occupation ordinance allowing <br />residents the ability to apply for a home occupation permit to operate a business within an <br />accessory structure and employ non-resident employees as outlined in the home <br />occupation ordinance. <br /> <br />6. That the Applicant has stated that the business is proposed to include replacement of <br />auto glass, small mechanical repair including repair of belts, brakes, rotors, calipers, <br />struts, hubs, spindles, axles, alternators, starters, spark plugs onthe Subject Property. <br />
