<br />6. That the Subject Property is surrounded by lots of various sizes; residential lots on 164th <br />Lane range from approximately 0.70 acres to 1.39 acres, to the east are two parcels of <br />about 2.3 acres, to the south a 10.06 acre residential parcel, and 3 cultivated fields to the <br />north. <br /> <br />7. That the Applicant will reside in the home on the Subject Property. <br /> <br />8. That the Applicant's business does not typically receive material truck deliveries, does <br />not have customers coming to the property, and is located on a county road; therefore, the <br />use should not create excessive vehicular traffic to the Subject Property as defined in <br />City Code Section 9.11.04. <br /> <br />9. That the Applicant's business will operate 24 hours a day, 7 days a week.. <br /> <br />10. That the Applicant's business currently has two commercial vehicles to support the <br />operation of the tow and recovery service. <br /> <br />11. That there is currently outside storage of business vehicles on the Subject Property. <br /> <br />12. That the Subject Property has parking and maneuvering areas will need to be upgraded <br />to class V, concrete or bituminous materials as defined in City Code Section 9.11.08. <br /> <br />13. That the Subject Property does have the necessary screening for commercial vehicles <br />that are parked outside for a period exceeding eight (8) hours as defined in City Code <br />Section 9.11.08 if the vehicles are parked in the side yard of the Subject Property. <br /> <br />14. That there is adequate room to move to extend the parking area toward the back of the <br />Subject Property, thus making the vehicles less visible, but that it would require the <br />removal of trees. <br /> <br />15. That the home occupation has the potential to create a nuisance to neighbors because of <br />excessive noise and vibration from tow vehicles traveling to and from the Subject <br />Property . <br /> <br />16. That there would be no exterior signage promoting the business on the Subject Property. <br /> <br />17. That all structures shall comply with all applicable codes, including building, fire and <br />zomng. <br /> <br />18. That the proposed use will not adversely impact traffic in the area. <br /> <br />19. That the proposed use will be compatible with the residential neighborhood due to <br />density and lot size of the surrounding lots. <br /> <br />RESOLUTION #09-08-189 <br />Page 2 of 4 <br />
