<br />AGREEMENT OF ASSESSMENT AND WAIVER OF IRREGULARITY AND APPEAL <br /> <br />THIS AGREEMENT, is made this_ day of ,2009, between the City of Ramsey, a Minnesota, <br />municipal corporation (City), and Donna and Joseph Hunt, wife and husband, the (Owner). <br /> <br />WHEREAS, the Owner is the fee title owner of certain real property, hereinafter referred to as the <br />Property, commonly known as 16207 Azurite Street NW in the City of Ramsey and legally described as: <br /> <br />That part of the west 440 feet ofE1/2 ofNE1/4 of Section 15 Township 32 Range <br />25 located in Anoka County, Minnesota lying south of the north 1838 feet thereof <br />and lying north of the following described line "A" and lying east offollowing <br />described line "B". <br /> <br />Line "A" is described as following: beginning at a point on north line of said east <br />1/2 ofNE1/4 of Section 15,220 feet west ofNE comer thereof, thence S 0 degrees <br />22 minutes 24 seconds east, assumed bearing, along a line parallel with the east <br />line of said section 1620.3 ft; thence south 2 d~grees 16 minutes 03 seconds east a <br />distance of 229.40 ft; thence south 61 degrees 26 minutes 37 seconds west a <br />distance of 334.05 ft; thence south 68 degrees 52 minutes 07 seconds west a <br />distance of 198.15 feet; thence north 49 degrees 57 minutes 03 seconds west a <br />distance of 145.26 ft; thence south 76 degrees 40 minutes 07 seconds west a <br />distance of 109.15 feet; thence south 49 degrees 17 minutes 52 seconds west a <br />distance of 162.8 ft; thence north 80 degrees 04 minutes 50 seconds west a distance <br />of 100.95 feet and said line "A" there terminating. <br /> <br />Line B is described as follows: beginning at a point on the north line of said east <br />E1/2 ofNE1/4 of Section 15,220 feet east of the west line of said eastl/2; thence <br />south 00 degrees 15 minutes 56 seconds e parallel with the west line of said eastl/2 <br />a distance of 1359.65 ft; thence south 7 degrees 12 minutes 50 seconds west a <br />distance of351.5 ft; thence south 14 degrees 51 minutes 16 seconds east a distance <br />of243.22 ft; thence south 16 degrees 52 minutes 14 seconds west 205.04 ft and <br />said line "B" there terminating; the above excluding roads, and subject to <br />easements of record. <br /> <br />WHEREAS, the onsite septic system serving the Property has failed and is a public health hazard <br />which has been ordered to be repaired / replaced; and, <br /> <br />WHEREAS, the Owner is unable to finance the repair/ replacement of the property's onsite <br />septic system; and, <br /> <br />WHEREAS, the City has adopted a policy entitled "Septic System Repair" hereinafter referred to <br />as the Policy, a copy of which is appended hereto as Appendix A; and, <br />
