MEMORANDUM OF UNDERSTANDING <br />FOR THE RECONSTRUCTION OF THE INTERSECTION OF COUNTY STATE AID <br />HIGHWAY 5 (NOWTHEN BOULEVARD) AND 167 AVE NW IN THE CITY OF RAMSEY <br />(SAP 199 - 102 -006) <br />This is a Memorandum of Understanding (MOU) between the County of Anoka, State of Minnesota, a <br />political subdivision of the State of Minnesota, 2100 Third Avenue North, Anoka, Minnesota, 55303, <br />hereinafter referred to as "County ", and the City of Ramsey, a municipal corporation under the laws of <br />the State of Minnesota, 7550 Sunwood Drive NW, Ramsey, Minnesota, hereinafter referred to as the <br />"City" <br />The parties to this MOU agree in principle that construction of City State Aid Project No. 199- 102 -006 <br />collectively referred to as the "Project" is in the best interest of the traveling public. <br />IMPROVEMENTS: <br />SUMMARY: <br />DATED August 10, 2009 <br />(Rev'd September 21, 2009) <br />It is agreed by the parties that the CSAH 5/167` Ave NW intersection will be improved with the City's <br />167 Ave NW 2009 reconstruction project to include the addition of a new right turn lane for <br />southbound CSAH 5 to westbound 167 Ave. This is consistent with the Anoka County Highway <br />Department (ACHD) Engineering Plan Review Process. <br />Through the ACHD Engineering Plan Review Process, it was also recommended that the city add left <br />turn lanes for northbound and southbound CSAH 5 as part of this city project due to concerns about the <br />future traffic volumes along 167 Ave related to future planned city roadway improvement projects. It <br />is agreed by the parties that the city shall notify the ACRD prior to any future city roadway <br />improvements being made that would increase traffic volumes at the CSAH 5 /167 Ave intersection. <br />After notification from the city, the county will make a determination to add left turn lanes and any other <br />mitigation warranted, for northbound and southbound CSAH 5 at this intersection. At a minimum, left <br />turn lanes will be required to be constructed. All costs required for this work shall be paid for by the <br />city, including right of way, design, and construction. The construction of the improvements to CSAH 5 <br />shall occur either before or concurrently with the future city roadway improvements, as detailed above. <br />In addition, to further mitigate the intersection safety issues, the city shall also coordinate sight distance <br />improvements with the property owner in the northwest quadrant of the intersection to improve the <br />safety at the intersection. This work involves the clearing of trees and shrubs within the sight triangle to <br />improve visibility. The city shall prepare a summary of this activity to the county at the conclusion of <br />the project detailing the discussions with the property owner, work performed as part of the project, and <br />future work to be performed. <br />Upon acceptance and signatures by the parties of this MOU, this agreement shall require the city to <br />construct the southbound CSAH 5 to westbound 167 Ave NW right turn lane and to work with the <br />adjacent property owner in the northwest corner of the intersection to clear the trees and shrubs within <br />the sight triangle to increase visibility. In addition, the city shall notify the Anoka County Highway <br />
