He advised that if this item <br />was approved it would be brought back to the Council on October 28, 2009. <br /> <br />Councilmember Wise confirmed that no other bonds were currently being paid through the State <br />Aid account. <br /> <br />Councilmember Look stated that he voted against this recommendation during the Finance <br />Committee meeting because of issues with the joint powers agreement. He stated that he was <br />reluctant to spend future State Aid dollars on a project that had already been completed. <br /> <br />Finance Director Lund explained why the amount changed from $850,000 to $1,300,000 and <br />what would be included with the project. She explained that Anoka County funded the project <br />but would bill the City for their portion per the Joint Powers Agreement. <br /> <br />Councilmember Dehen questioned how the City could not pay for something already received <br />and whether there was a valid legal ground to disagree. <br /> <br />City Attorney Goodrich confirmed that this item was already agreed upon by the Joint Powers <br />Agreement and could only be denied on the basis that there was a breach of contract. He advised <br />that the City could be sued if they do not agree to pay their portion per the Joint Powers <br />Agreement. <br /> <br />Motion by Councilmember Elvig, seconded by Mayor Ramsey, to adopt Resolution #09-09-232 <br />Authorizing the Issuance of General Obligation State Aid Road Bonds in the amount of <br />$1,360,000. <br /> <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Dehen, Jeffrey, McGlone, <br />and Wise. Voting No: Councilmember Look. <br /> <br />Case #3: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to Maintain <br />Four or More Dogs at 6738 153rd Lane NW; Case of Eric and Jamie Topero <br /> <br />Associate Planner Gladhill reviewed the staff report. <br /> <br />Motion by Mayor Ramsey seconded by Councilmember Elvig, to Adopt Resolution #09-09-233 <br />adopting Findings of Fact #0856 relating to the applicants' request for a Conditional Use Permit <br />for a private dog kennel for five dogs at 6738 - 153rd Lane NW. <br /> <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Jeffrey, Look, McGlone, <br />and Wise.
