<br />Further discussion: Jamie Topero presented pictures and vaccination certificates of the four dogs <br />she possesses. She explained that one of the dogs has a heart condition and that is the reason <br />they are attempting to move. She advised that if they do purchase the home they would apply for <br />a permit to extend the fence in the backyard. Councilmember Look stated that the permit allows <br />up to four dogs and questioned if the homeowner would eventually obtain larger dogs. Mrs. <br />Topero stated that she would continue to have only small dogs. Councilmember Dehen <br />questioned the problem with the current neighbor in Bloomington. Mrs. Topero stated that the <br />current neighbor attempts to cause problems with the dog with the heart condition, such as <br />lighting fireworks or making other loud noises to scare the dog. Councilmember Dehen stated <br />that in situations where people have a large number of animals it sometimes becomes an issue of <br />the animals not being cared for. He recommended that the Conditional Use Permit be reviewed <br />after one year along with a requirement for a fence along the property. The Council continued to <br />discuss specifics in regard to care for the animals, levels of noise, and limits on anirnals in the <br />City of Bloomington. Mrs. Topero stated that the City of Bloomington allows four animals with <br />a fifth animal being allowed for up to 30 days, and confirmed that they had not received any <br />noise complaints in the City of Bloomington. <br /> <br />Motion by Councilmember Dehen, seconded by Councilmember Wise, to amend the motion on <br />the table to include a one-year review of the permit, at no cost to the resident ifno complaints are <br />received. <br /> <br />Further Discussion: City Attorney Goodrich suggested that the condition be added to the first <br />section of the Conditional Use Permit. Mayor Ramsey spoke against the amendment and <br />explained that the permit could be pulled if an issue arises. Councilmember Elvig concurred. <br /> <br />Motion to amend failed. Voting Yes: Councilmembers Dehen and Wise. Voting No: Mayor <br />Ramsey, Councilmembers Elvig, Jeffrey, Look, and McGlone. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #4: <br /> <br />COBsider Award of Bids for IP D9 22 2DD9 Storm Sewer ImproyemeBts <br /> <br />This item was postponed to September 28,2009, upon adoption of the agenda. <br /> <br />Case #5: <br /> <br />Award Contract for Consulting Services for the Development of East <br />Meandering Commons Park <br /> <br />City Engineer Himmer reviewed the staff report. <br /> <br />Councilmember Dehen stated that it seemed when the RFP was done. it was difficult to provide <br />information as the City was unsure what was desired and questioned how staff dealt with that <br />lssue. <br /> <br />City Engineer Himmer stated that the City is attempting to develop a master plan for the park, <br />but recognized that some of the clarity is lost when dealing with actual construction.
