Subd. 12. Violation~ and Penalty. The subdividing, re-subdividing, <br />conveyance of land or construction of a sewage disposal system not in accordance with the <br />requirements of this Section may be enforced by mandamus, injunction or any other anr~rm~riate <br />remedy in any court of competent jurisdiction. 9.50.50 <br /> <br />9.50.31 <br /> <br />9.50.31 through 9.50.49 (reserved) <br /> <br />9.50.50 <br /> <br />Construction of Improvements <br /> <br /> Subd. 1. General Conditions. As a condition of final plat approval Ge <br />Development Agreement shall make provision in the rammer hereinafter set forth for the <br />installation, at the sole expense of the subdivider, of such improvements as shall be required by <br />the Ci~, which improvements may include, but are not limited to items included in Subd. 2a 1 <br />and 2. The installation of said improvements shall be in conformi~ with City approved <br />construction plans and specifications and all applicable City standards and code sections. The <br />Subdivider shall not commence with construction of improvements until financial assurances are <br />provided as contained in the Development A~eement. <br /> <br />Subd. 2. Basic Improvements Required <br /> <br />ao <br /> <br />Policy. It is hereby declared to be the policy of the City to, as soon as <br />practicable after approval of the proposed plat, require the installation of alt <br />o£ the following improvements within the subdivision. In addition to Stage I <br />and Stage II Improvements, additional improvements may be required in the <br />specific Development Agreement. <br /> <br />Stage I Improvements. Major construction items needed to be <br />constructed with a plat prior to issuance of any building permits: <br /> <br />(a) Trunk and lateral Sanitary Sewer <br /> <br />(b) Trunk and lateral Waterman <br /> <br />(c) Storm Drainage Facilities (when specified) <br /> <br />(d) Storm Water Maintenance through 90% buildout <br /> <br />(e) Streets <br /> <br />(f) Concrete Curb and Gutter (Urban) <br /> <br />(g) Street Traffic Control Signals <br /> <br />(h) Lot Grading <br /> <br /> 9.50 Subdivision Regulations <br />-324- <br /> <br />9-36 <br /> <br />August _00.> Draft <br /> <br /> <br />
