Subd. 12. Violation~ and Penalty. The subdividing, re-subdividing, conveyance of land or construction of a sewage disposal system not in accordance with the requirements of this Section may be enforced by mandamus, injunction or any other anr~rm~riate remedy in any court of competent jurisdiction. 9.50.50 9.50.31 9.50.31 through 9.50.49 (reserved) 9.50.50 Construction of Improvements Subd. 1. General Conditions. As a condition of final plat approval Ge Development Agreement shall make provision in the rammer hereinafter set forth for the installation, at the sole expense of the subdivider, of such improvements as shall be required by the Ci~, which improvements may include, but are not limited to items included in Subd. 2a 1 and 2. The installation of said improvements shall be in conformi~ with City approved construction plans and specifications and all applicable City standards and code sections. The Subdivider shall not commence with construction of improvements until financial assurances are provided as contained in the Development A~eement. Subd. 2. Basic Improvements Required ao Policy. It is hereby declared to be the policy of the City to, as soon as practicable after approval of the proposed plat, require the installation of alt o£ the following improvements within the subdivision. In addition to Stage I and Stage II Improvements, additional improvements may be required in the specific Development Agreement. Stage I Improvements. Major construction items needed to be constructed with a plat prior to issuance of any building permits: (a) Trunk and lateral Sanitary Sewer (b) Trunk and lateral Waterman (c) Storm Drainage Facilities (when specified) (d) Storm Water Maintenance through 90% buildout (e) Streets (f) Concrete Curb and Gutter (Urban) (g) Street Traffic Control Signals (h) Lot Grading 9.50 Subdivision Regulations -324- 9-36 August _00.> Draft
