Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Elvig, Look, Dehen, Jeffrey, McGlone, and Wise. Voting No: None. Case #2: Request for Division of Remaining Assessment Balance for Improved Project Associate Planner Gladhill reviewed the staff report. Councilmember Elvig asked what the remedy was so the City knew that they would get the funds from the sale. Associate Planner Gladhill noted the <:;:ity could hold off on the split until the funds were received. City Attorney Goodrich stated the City could tell the title company not to allow the split to go forward without the funds secured. Tim Holm, applicant, noted everything would be distributed by the title company and he would not be handling any of the funds. Councilmember Wise asked what the downside was of splitting the lots. Associate Planner Gladhill responded it added about $4,000 to the land sale of lots of 1 and 2, which would be recovered upon future sales. Councilmember Dehen asked what the process was for waiting for the funds upon future sales. City Attorney Goodrich responded the term of the assessment would not be extended, but a larger amount would be put on the assessment. Associate Planner Gladhill noted upon sale, the assessment balance would need to be paid in full. Motion by Councilmember Elvig, seconded by Councilmember Wise, to adopt Resolution 09- 11-253 approving the request to divide the remaining assessment balance equally among Lots 1 and 2, Block 1, Ebony Woods subject to payment of all delinquent taxes and fees. Case #3: Consider Use of City Property Located at 16600 St. Francis Boulevard NW City Engineer Himmer reviewed the staff report. Councilmember Dehen asked if the septic system was in need of repair.
