Voting No: None. <br /> <br />Case #2: <br /> <br />Request for Division of Remaining Assessment Balance for Improved Project <br /> <br />Associate Planner Gladhill reviewed the staff report. <br /> <br />Councilmember Elvig asked what the remedy was so the City knew that they would get the funds <br />from the sale. <br /> <br />Associate Planner Gladhill noted the <:;:ity could hold off on the split until the funds were <br />received. <br /> <br />City Attorney Goodrich stated the City could tell the title company not to allow the split to go <br />forward without the funds secured. <br /> <br />Tim Holm, applicant, noted everything would be distributed by the title company and he would <br />not be handling any of the funds. <br /> <br />Councilmember Wise asked what the downside was of splitting the lots. <br /> <br />Associate Planner Gladhill responded it added about $4,000 to the land sale of lots of 1 and 2, <br />which would be recovered upon future sales. <br /> <br />Councilmember Dehen asked what the process was for waiting for the funds upon future sales. <br /> <br />City Attorney Goodrich responded the term of the assessment would not be extended, but a <br />larger amount would be put on the assessment. <br /> <br />Associate Planner Gladhill noted upon sale, the assessment balance would need to be paid in full. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Wise, to adopt Resolution 09- <br />11-253 approving the request to divide the remaining assessment balance equally among Lots 1 <br />and 2, Block 1, Ebony Woods subject to payment of all delinquent taxes and fees. <br /> <br />Motion carried.
