<br />Final Development Agreement <br />The final development agreement phase is the period where the details of what is constructed, timing, <br />phasing, public improvements, lalld payments, etc are negotiated. Ehlers, along with the City's attorney <br />alld staff representative, will negotiate the terms of the Agreement. Ehlers has extensive experience in <br />this area, but just as critical as experience, is the need for a Finallcial Advisor that is independent. Ehlers <br />works only for public sector clients alld will not work for developers, ensuring that you Call avoid even a <br />perception of allY conflict of interest. <br /> <br />Ehlers will provide staff rep01is alld executive summary of the Agreement and present the terms to the <br />City Council for consideration and approval. We suggest that a preliminary term sheet be brought before <br />the City Council for them to review and modify as needed before bringing a full Development <br />Agreement back to them for review. Ehlers finds that all executive summary of the final Agreement is <br />helpful for the Council's review because it takes the legalese out of the full document alld highlights the <br />main alld critical business points. <br /> <br />Coordinate Project Team meetings, develop project timeline and project status <br />report to meet goals of development <br />Keeping people and processes moving along smoothly is not always an easy task. Ehlers recommends <br />establishing members of the Project Tealn up front (i.e. planning, engineering, public works, developer, <br />etc) and setting up regularly scheduled meetings of the group. We recommend meeting bi-weekly at a <br />minimum. When the development process picks up, weekly meetings will likely be required and as <br />development finishes up, monthly meetings may only be required. The project tealn meetings are <br />scheduled in advallce based upon consensus of the project team. They are always held on the Salne day, <br />Salne time and same location alld when determined, the meetings are placed on all members of the <br />project tealn's calendar. <br /> <br />To keep the project tealn informed alld completing necessary tasks on time, Ehlers has developed a <br />timeline tracking spreadsheet that has built in flexibility to change various aspects of the development <br />process as needed, along with a project status tracking rep01i. The project status rep01i alld time line are <br />reviewed alld updated at meetings of the project tealn. We have found these to be invaluable tools in <br />keeping people alld processes on track alld keeping all members of the project tealn infonned of what is <br />happening alld their corresponding roles alld responsibilities. In addition, Ehlers will coordinate actions <br />of project team members, monitor progress alld facilitate regular tealn meetings <br /> <br />Prepare weekly, bi-weekly or monthly status reports for council <br />Keeping Council members informed about the process and project is critical to its success. Ehlers <br />prepares simple, straight forward project updates that Call be provided to the Council on a weekly, bi- <br />weekly or monthly basis. In addition, Ehlers can attend council meetings as needed to provide verbal <br />project updates. <br /> <br />Develop all correspondence required to keep staff and Council informed as well <br />as all correspondence required to seek needed Council and Commission <br />approval <br />In the role of project manager, Ehlers views itself as an extension of staff alld thus, will follow City <br />process for keeping staff, project tealn and council members informed on a regular basis.
