The purpose of this letter is to clarify the City's stance regarding `grandfathered' rights <br />(designation of lawful non - conforming use) on the property located at 8110-Highway 10 NW, <br />Ramsey, MN 55303. Current regulations require any open and outdoor service, sales, display or <br />rental areas to tier surfaced with concrete or blacktop and finished with continuous concrete <br />curbing. Furthermore, current regulations for the B -2 Business District also-prohibit outdoor <br />storage activities: <br />• The previous owner of this property, which operated Hi -Ten Sports on the site, did utilize the <br />unimproved area south of the building initially as outdoor sales and display: However, over time; <br />that use morphed from,outdoor sales and display into outdoor storage of old snowmobiles and <br />other recreational equipment retained specifically for salvaging of parts. The initial use, outdoor <br />sales on . an unirfrproved surface, was designated as lawful non- conforming as it was in existence . <br />prior to the current regulations. However, once the use evolved into a salvage operation, the <br />lawful non - conforming designation was lost. Salvage operations have never been a permitted use <br />and thus would never be considered lawful non - conforming. <br />City Code Section 9.03.14 (Non- conforming Structures and Uses) Subd. 2j. states that whenever <br />a- lawful non - conforming use of a structure or land is discontinued for a continuous period of six <br />(6) months, any future use of said structure or lands shall be made to comply with the provisions <br />of City Code. After Hi -Ten Sports terminated its business, the unimproved area south of the <br />building sat vacant until Amazon Auto began utilizing it. The lapse of time between the current <br />use and the previous lawful non - conforming use exceeded six (6) months; therefore, it is the <br />City's opinion that any prior lawful non - conforming designation is no longer applicable. <br />If this unimproved area south of the building is to be used for any type of open and outdoor <br />service, sales, display or rental activity, than it must be paved and curbed in accordance with City <br />Code.
