He stated he was not sure why this was a public health and safety hazard and who decided
it was a public healthy and safety hazard.

Assistant City Engineer Jankowski responded a failing septic system was determined by Council
and the State to be a public health and safety hazard. He noted this was a greater hazard because
contaminates could leave the property and contaminate service water which is distributed over a
wide area. He stated animals could also come into contact with the raw sewage, pick up bacteria
and carry it into the community. He believed this was a clear .case of public health and
something needed to be done about it.

Councilmember Look stated the question in his mind was if the septic system should be replaced
or repaired.

Councilmember Dehen asked if there were any problems with the City putting on a 25 percent
premium charge.

City Attorney Goodrich responded the 25 percent premium charge was a standard charge. He
indicated the City was not gaining on this charge. He did not believe this was setting any
precedent and there was no legal liability.

Motion by Councilmember Look, seconded by Councilmember Wise, to adopt Resolution 09-11-
262 directing staff to cause the repair of the septic system at 16207 Azurite Street in accordance
with the conditioned specified with the quote information being kept private until all quotes are
received in the staff recommendations.

City Council / November 10, 2009
Page 5 of8
