<br />Attachment C <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09~12-_ " <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT" <br />BASED ON FINDINGS OF FACT #_ AND DECLARING TERMS OF PERMIT FOR <br />PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF SIX DOGS ON A PARCEL <br />.. OF LAND AT 15916 ST FRANCIS BLVD NW. <br /> <br />WHEREAS, the Ramsey City Council adopted Resolution #09-12-_adopting Findings <br />of Fact #_ for this use and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On December 22, 2009, a Conditional Use Permit ("Permit") was issued by the City of Ramsey <br />("City") to Michael Buckman ("Permittee") for a private dog kennel to maintain a maximum of <br />four dogs on the property generally known as "15916 St Francis Blvd NW and legally described as <br />follows: <br /> <br />That part of the northeast quarter of the southeast quarter lying southerly ofthe <br />south line of the plat of Hall-Anderson Acres, Anoka County, Minnesota; westerly <br />of the westeJ;1y right of way line ofSt. Francis Blvd. (AKA T H No 47) and <br />northerly and westerly of the following described line, commencing at the <br />southwest comer of said Quarter Quarter, thence east along the south line thereof 10 <br />feet to the point of beginning ofline to be described, thence north and parallel with <br />the west line of said Quarter Quarter,120 feet, thence east and parallel with the <br />south line of said Quarter Quarter to the intersection with the westerly right of way <br />line of St. Francis Blvd. NW (AKA T H No. 47) and there terminate except roads <br />" subject to easement of record <br /> <br />("Subject Property"). <br /> <br />This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br /> <br />1. This Permit shall remain in effect so long as the conditions imposed herein are complied <br />with. <br /> <br />2. This Permit shall allow for the maintenance of a maximum of six (6) dogs on the Subject <br />Property over six (6) months of age. . <br /> <br />3. " Upon eonfrrniation of any complaints of odor or noise problems relating to the dogs on the <br />Subject Property, the City may take action to' abate the nuisance in accordance with <br /> <br />9 <br />
