CASE # ~

Public Hearing
REQUEST FOR i\. CONDITIONAL USE PERMIT TO EXCEED TlIE TOTAL
AMOUNT OF ACCESSORY STRUCTURE SQUARE FOOTAGE;
CASE OF GENE AND CINDY GOEDE
By: Tim Gladhill, Associate Planner

Background:

On November 18,2009, the City received a request from Gene and Cindy Goede for conditional
use permit (CUP) to exceed the amount of square footage allowed for a~cessory structures
located at 17725 BimghSt. N.W.

Notification:

In accordance with City Code, Staff attempted ,to notify property owners within 7~0 feet of the .
property .

Observations:

The applicant is requesting a CUP to be allowed to keep an. existing structure of approximately
1,500 square-feet. This building would serve as a storage area for- items typically considered
accessory to the residential .use on the subject property. This structure w:as required to be
removed per the terms of an interim use permit approved in November, 2008, which expired nine
(9) months following approval of the interim use permit. At that time, the interim use Rermit was
approved to allow for the construction of a 4,400 square foot accessory structure, partially used
for storage of commercial motor vehicles and equipment for Trent's Tree Service, an approved
home occupation on the Subject Property. .

At this time, the subject property has a 480 square root detached garage, a 1,500 square foot
accessory structure, and a 4,400 square foot accessory structure for a total of 6,380 square feet of
accessory structure space. Prior to approval of the interim use permit, there was approximately
1,980 square feet of accessory structure space. Due to the fact that the existing 1,500 square foot
structure was to be removed, the City allowed the Applicant to amend building plans to construct
a 4,400 square foot structure versus a 4,000 ~quare foot accessory structure as originally
proposed, in order to maximize the allotment of accessory structure space. Keeping all existing
accessory structure would equate to a total of a 1,280 square foot overage.

The business currently being operated on the subject property.is a tree service. It appears that
there are at least five vehicles directly related to the operation of the home occupation. Also,
there is substantial evidepce. of the home occupation visible from outside the home in the form of
stockpiles of wood and. tree triminings. Much of the off':street parking concerns have been
addressed with the construction of the 4,400 square foot accessory structure. However, Staffhas
not verified if the Applicant has complied with the requirement to upgrade all maneuvering areas

19
