Absent: Board Members Brauer, Cleveland and Levine. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: Public Hearing - Request for a Variance to Construct a Detached Accessory <br />Building Nearer the Front Property Line than the Principal Structure at 5421 165th Lane <br />NW; Case of Roger and Barbara Anderson. <br /> <br />Chairperson Van Scoy closed the regular portion of the Board of Adjustment meeting at 7:01 <br />p.m. in order to conduct the public hearing. <br /> <br />Public Hearine <br /> <br />Chairperson Van Scoy called the public hearing to order at 7:01 p.m. <br /> <br />Presentation <br /> <br />Environmental Coordinator Anderson presented the Staff Report <br /> <br />Citizen Input <br /> <br />Planning Manager Miller stated she received a call from Dong Yijie, 5428 165th Lane stating he <br />does not support this variance, because of the removal of landscaping and has concern with the <br />view of the streetscape. <br /> <br />Roger Anderson, 5421 165th Lane NW, the applicant stated there is not enough room from the <br />drain field and the side of the existing garage. The drain field is adjacent to the garage. The <br />drain field has to be 20 feet from any structure. <br /> <br />Environmental Coordinator Anderson stated he did do a site inspection, and there is staking <br />where the drain field is located. Finding of Fact #10 should state there needs to be a 20 foot <br />setback rather than a 10 foot setback from the drain field perimeter. <br /> <br />Chairperson Van Scoy asked what the distance was from the existing garage and the drain f1eld. <br /> <br />Environmental Coordinator Anderson stated there is not. very much space between the existing <br />attached garage and the western property line. <br /> <br />Planning Manager Miller stated the city does not enforce private covenants; the home owners are <br />responsible for enforcing the private covenants of the development. <br /> <br />Chairperson Van Scoy asked if the applicant had any issues with the stipulation of a brick fa9ade <br />to match the house. <br /> <br />Board of Adjustment / November 5, 2009 <br />Page 2 of 4 <br />
