<br />Mr. Anderson stated the garage would not be facing the street and will not be that visible to <br />anyone driving by. <br /> <br />Commissioner Hunt asked if there was a barrier of trees between the structure and the street. Mr. <br />Anderson replied there would be three trees remaining; six or seven trees will have to be <br />removed. <br /> <br />Discussion ensued regarding the dimensions of the lot. <br /> <br />Assistant City Engineer Jankowski left to look at the online maps to get the dimensions from the <br />property line to the attached garage. <br /> <br />Motion by Board Member Brauer, seconded by Chairperson Van Scoy, to temporarily recess the <br />public hearing and Board of Adjustment meeting until the assistant engineer returns with the <br />dimensions. <br /> <br />Motion Carried. Voting Yes: Chairperson Van Scoy, Board Members, Brauer, Dunaway, Hunt <br />and Rogers. Voting No: None. Absent: Board Members Cleveland and Levine. <br /> <br />The public hearing and Board of Adjustment temporarily recessed at 7 :27 p.m. <br /> <br />Chairperson Van Scoy reconvened the Board of Adjustment public hearing and meeting at 8:50 <br />p.m. <br /> <br />Environmental Coordinator Anderson stated the dimensions from the western property line and <br />the side wall of the attached garage is 60 feet. There is a setback of 20 feet from the drain field <br />and the drain field is within that 60 feet. <br /> <br />Motion by Chairperson Van Scoy, seconded by Commissioner Dunaway, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Van Scoy, Board Members, Dunaway, Brauer, Hunt <br />and Rogers. Voting No: None. Absent: Board Members Cleveland and Levine. <br /> <br />Board Business <br /> <br />Chairperson Van Scoy called the Board of Adjustment meeting back to order at 8:51 p.m. <br /> <br />Discussion ensued regarding the building materials required for the garage. <br /> <br />Motion by Chairperson Van Scoy, seconded by Board Member Brauer, to adopt Resolution #09- <br />11-254 adopting Findings of Fact #0857 relating to Roger and Barbara Anderson's request for a <br />variance at 5421 165th Lane NW with the correction to FOF #10 to read 'That MN Rules Chapter <br />7080 requires a minimum setback of twenty (20) feet between an individual sewage treatment <br />system (ISIS) and a building." <br /> <br />Board of Adjustment / November 5, 2009 <br />Page 3 of 4 <br />
