<br />CASE # '7, 0;;1 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE TOTAL <br />AMOUNT OF ACCESSORY STRUCTURE SQUARE FOOTAGE; <br />CASE OF GENE AND CINDY GOEDE <br />By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />On November 18, 2009, the City received a request from Gene and Cindy Goede for conditional <br />use permit (CUP) to exceed the amount of square footage allowed for accessory. structures <br />located at 17725 Baugh St. N.W. <br /> <br />Notification: <br /> <br />In accordance with City Code, Staff attempted to notify property owners within 700 feet of the <br />property. <br /> <br />Observations: <br /> <br />The applicant iS'requesting a CUP to be allowed.to keep an existing structure of approximately <br />1,500 square-feet. This building would serve as a storage area for items typically considered <br />accessory to the residential use on the subject property, This structure was required to be <br />removed per the terms of an interim use permit approved in November, 2008, which expired nine <br />(9) months following approval of the interim use permit. At that time, the interim use permit was <br />approved' to allow for the construction of a. 4,400 square foot accessory structure, partially used <br />for storage of commercial motor vehicles and equipment for Trent's Tree Service, an approved <br />home occupation on the Subject Property, <br /> <br />At this time, the subject property has a 480 square foot detached garage, a 1 ,500 ~quare foot <br />accessory structure, and a 4,400 square foot accessory structure for a total of 6,380 square feet of <br />accessory structure space. Prior to approval of the interim use permit, there was approximately <br />1,980 square feet of accessory structure space. Due to the fact that the existing 1,500 square foot <br />structure was to .be removed, the City allowed the Applicant to amend building plans to construct . <br />a 4,400 square foot structure versus a 4,000 square foot accessory structure as originally <br />proposed, in order to maximize the allotment of accessory structure space, Keeping all existing <br />accessory structure would equate to a total of a 1,280 square foot overage. <br /> <br />The business currently being operated on the subject property is a tree service. It appears that <br />there are at least five vehicles directly related to the operation of the home occupation. Also, <br />there is substantial evidence of the home occupation visible from outside the home in the form of <br />stockpiles of wood and tree trimmings, Much of the off-street parking concerns have been <br />addressed with the construction of the 4,400 square foot accessory structure. However, Staffhas <br />not verified if the Applicant has complied with the requirement to upgrade all maneuvering areas <br />to a minimum of Class V. This requirement was placed in response to the outside storage area of <br />
