<br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #10-01-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN CONDITIONAL USE <br />PERMIT, TO EXCEED THE TOTAL AMOUNT OF ACCESSORY STRUCTURE <br />SQUARE FOOTAGE BASED ON FINDINGS OF FACT #_ AND DECLARING <br />TERMS OF PERMIT <br /> <br />WHEREAS, on November 18, 2009, Gene and Cindy Goede, husband and wife, (the <br />"Permittee"), properly applied for a conditional use permit for an overage in total accessory <br />building square footage established in City Code Section 9.11.02 on the property generally <br />known as 17725 Baugh Street N.W. and legally described as follows: <br /> <br />The south 495 feet ofthe west 880 feet of the Southwest Quarter of the Northeast Quarter <br />of Section 6, Township 32, Range 25, Anoka County, Minnesota as measured at right <br />angles to the south and west lines thereof (subject to County Road No, 83 Baugh Street) <br /> <br />("Subject Property"); and, <br /> <br />WHEREAS, the Planning Commission met on December 3, 2009 and conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1, That based on Findings of Fact # _, a conditional use permit (the "Permit") to keep a <br />1,500 square foot accessory building (the "Structure") originally required to be removed <br />per City Resolution 08-11-229, which will result in exceeding the total amount square <br />footage allowed by no more than 1,280 square feet on the Subject Property is hereby <br />granted to the Permittee, <br /> <br />2. That the Structure shall conform to all other requirements for accessory structures. <br /> <br />3. That the Permittee shall obtain all necessary permits prior to commencing any <br />construction of the Structure. <br /> <br />4. That no commercial or industrial activity of any type shall be permitted on the Subject <br />Property unless the necessary permits have been obtained from the City. <br /> <br />5. That the Structure may not be used for storage related to the Home Occupation. <br /> <br />6. That any repairs to fuel systems, electrical systems or repairs using open flame or welding <br />shall be prohibited in the Structure. with the exception of those activities required for <br /> <br />Resolution #10-01-_ <br />Page 1 of 4 <br />
