<br />Commission Business <br /> <br />Commissioner Dunaway questioned what would happen if the applicant moved. <br /> <br />Associate Planner Gladhill stated the conditional use permit runs with the property and <br />exchanges through property owners. For a home occupation permit the home owner has to have <br />ownership in the property and the business. This prevents it from being operated as an off-site <br />business. The home occupation permit is specific to an area and business; the use and who runs <br />it. The size of this property is 9.3 acres; the allowable accessory space is 5100 square feet. <br />There are a total of three accessory structures on the property totaling 6, 380 square feet, which <br />gives this an overage of approximately 1300 square feet. <br /> <br />Commissioner VanScoy asked if there were 10 acres how much square footage would be <br />allowed and what the zoning was. <br /> <br />Planning Manager Miller stated that 10 acres is allowed 6,000 square feet and the property is <br />rural developing. <br /> <br />Motion by Commissioner Van Scoy, seconded by Commissioner Brauer, to recommend that City <br />Council adopt Findings of Fact favorable to the Applicants' request for a conditional use permit <br />and removing Finding #10. <br /> <br />Motion Carried. Voting Yes; Chairperson Levine, Commissioners Van Scoy, Brauer, Dunaway, <br />and Hunt. Voting No: None. Abstain: Commissioner Cleveland. Absent: Commissioner <br />Rogers. <br /> <br />Motion by Commissioner Van Scoy, seconded by Commissioner Hunt, to recommend that City <br />Council adopt the resolution approving the Applicant's request for a conditional use permit for <br />an overage in allowable accessory structure square footage restrictions based on findings of fact <br />and with condition number six reading "That any repairs to fuel systems, electrical systems or <br />repairs using open flame or welding shall be prohibited in the Structure with the exception of <br />those repairs related to the structure itself' and review of combustible items by the Fire Inspector <br />or Fire Chief. <br /> <br />Commissioner Cleveland left the meeting at 9;20 <br /> <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Van Scoy, Hunt, Brauer and <br />Dunaway. Voting No: None.
