Public Works Director Olson stated in this case he had gone out and looked at this particular
driveway as well as driveways adjacent to this driveway and the City had not treated any
driveway differently.
Chairperson Elvig noted even if the City went in six inches, there would still be a lip.
Public Works Director Olson stated they could cut and remove, but he did not know how far it
should be done.
Chairperson Elvig stated he did not see what the City could do without setting a precedent. He
indicated he would be more concerned about Ms. Hjelm tripping and falling on her driveway
than in the road.
Public Works Director Olson stated in another ten years it was estimated the road would
probably be reconstructed, depending on the rating of the road.
Councilmember Dehen stated he believed the Committee's direction was when there was more
maintenance to be done on the road that this issue would be remedied.
Ms. Hjelm stated that recommendation was not acceptable to her. She indicated she paid good
money for this road and a "shoddy" job had been done. She stated she deserved the same as her
neighbors.
Chairperson Elvig stated roads were constructed this way and the transition that was there had to
be there. He stated the City would need to charge for any repairs. He explained the City
maintained the road, but the driveway was her responsibility to maintain. He noted the City had
an easement there, but the driveway and grass was hers.
Councilmember McGlone stated the City was not in the business of smoothing out the lips
created on driveways.
Councilmember Dehen asked if Ms. Hjelm would be able to pay for the amount going back ten
feet from where the road ends.
Ms. Hjelm responded it would depend on the cost, but she was thinking at some point down the
road, she would like concrete instead of asphalt. She did not know if a temporary fix was the
answer.
Motion by Chairperson Elvig, seconded by Councilmember McGlone, to recommend that the
City Council adopt staff's recommendation.
Motion carried. Voting Yes: Chairperson Elvig and Councilmembers McGlone and Dehen.
Voting No: None.
Case #2: Review Dennis Sharp Stormwater Utility Charges
Public Works Committee /November 17, 2009
Page 3 of 5
