<br />5. That on September 30, 2009, the Applicant properly applied for a home occupation <br />permit to be operated in a dwelling unit and accessory structure to operate a concrete and <br />masonry contracting service (the "Home Occupation") on the Subject Property. <br /> <br />6. That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 9.03.05 of the City Code on November 5, 2009, and that said <br />public hearing was properly advertised. <br /> <br />7. That the Subject Property is zoned R-l Residential Rural Developing, and the <br />surrounding parcels are also zoned R-l Rural Developing. <br /> <br />8. That the Subject Property is approximately 3.63 acres. <br /> <br />9. That the Subject Property is surrounded by lots of similar sizes and is bordered by <br />wetlands to the rear. <br /> <br />10. That the Applicant shall occupy the dwelling unit on the site of the Home Occupation. <br /> <br />11. That the Home Occupation is located in the dwelling unit and an accessory structure <br />located on the Subject Property. <br /> <br />12. That the area set aside for the Home Occupation in the dwelling unit shall be 140 square <br />feet of the 3,200 square foot dwelling unit, which equates to 4%, under the 20% allowed <br />by 9.11.04 (Home Occupations). <br /> <br />13. That the area set aside for the Home Occupation in the accessory structure shall be 1,600 <br />square feet and shall not exceed total accessory build space or height allowed on the <br />Subject Property, as established in 9.11.02 (Accessory Uses & Buildings). <br />Furthermore, at least 400 square feet of garage space will be reserved for indoor <br />residential parking and storage related to the residential us on the Subject Property. <br /> <br />14. That the City finds there is exterior evidence of the existence of the Home Occupation <br />on the Subject Property. The existence of equipment, materials, supplies, inventory, <br />and merchandise constitutes exterior evidence of the Home Occupation. The Applicant <br />has stated that miscellaneous form lumber, block, and brick will be store on the Subject <br />Property. Per 9.11.04 Subd. 3, the request shall be reviewed and approved by the City <br />Council. <br /> <br />15. That the City finds the off-street parking of commercial use vehicles and equipment is in <br />compliance with screening and surfacing requirements, as established in 9.11.08 <br />(Residential Off-Street Parking). The Applicant has stated that the in the application, the <br />Home Occupation currently has one commercial vehicle, a 1992 GMC Top Kick, to <br />support the operation of the business. An inspection of the Subject Property by the City <br />also revealed a personal use vehicle with CKC lettering, a small, motorized commercial- <br />use piece of equipment, a skid steer and associated attachments, a commercial use trailer, <br />and a trailer/generator combination. <br /> <br />16. That there are no interior or exterior business signs or display related to the Home <br />Occupation on the Subject Property. <br /> <br />RESOLUTION #09-11-270 <br />Page 2 of 4 <br />
