MULTI-FAMILY RESIDENTIAL DESIGN GUIDELINES AND STANDARDS <br /> <br />III. GENERAL PROVISIONS <br /> <br />A. GENERAL INTENT <br /> <br /> The general intent of these Multi-Family Residential Design Guidelines and Standards is <br /> to improve the overall quality of multi-family development in Overland Park, ensure the <br /> compatibility of multi-family development with surrounding land uses, and improve the <br /> user-friendliness of the document and review process. <br /> <br />B. APPLICABILITY <br /> Unless exempt under subsection III.C. (Exemptions) below, these Multi-Family <br /> Residential Design Guidelines and Standards shall apply to all new multi-family <br /> development, including duplexes, within the City of Overland Park that occurs in any of <br /> the following zoning districts: RP-2, R-3 and RP-3, RP-4, RP-5, and RP-6. (See Section <br /> V, Definitions, below for definition of "multi-family development.") They shall also apply <br /> to all major rehabilitation of an existing multi-family structure. Major rehabilitation shall <br /> mean any renovation, restoration, modification, addition, or retrofit of a structure or site <br /> that exceeds fifty percent (50%) of the current appraised value of any structure or site as <br /> established by Johnson County. Rehabilitation costs shall be aggregated over a five- <br /> year period to determine whether the development is subject to these rules. Major <br /> rehabilitation shall not include routine maintenance and repair of a structure or other <br /> feature on the surrounding site, such as roof replacement or general repairs to a <br /> parking area or other site feature. <br /> <br />6. EXEMPTIONS <br /> <br /> The following developments shall be exempt from application of these Multi-Family <br /> Residential Design Guidelines and Standards: A development that is subject to the <br /> Overland Park Infill/Redevelopment Design Standards and. Guidelines; and a <br /> development that is subject to the Overland Park Downtown Design Standards and <br /> Guidelines. <br /> <br />D. REVIEW PROCESS <br /> <br />General <br />These Multi-Family Residential Design Guidelines and Standards shall be applied in <br />the normal review processes for, as applicable, rezonings, site plans, subdivision <br />plats, and development plans, as set forth in Chapter 18.140 of the UDO. <br /> <br />Site Plan/City Approval Required Prior to Permits <br />A developer shall submit a site analysis' and a site plan to city staff prior to <br />application for a building permit for multi-family development so that city staff can <br />review the site plan for compliance with these Multi-Family Residential Design <br />Guidelines and Standards. This requirement for a site plan shall apply even where <br />Chapter 18.140 would otherwise allow a multi-family use to be developed without <br />prior city approval of a development plan or site plan. <br /> <br />CITY OF OVERLAND PARK, KANSAS 6 OCTOBER 7, 2002 <br /> <br /> <br />
