Councilmember McGlone felt that the City is over-regulating and we do not need this. <br />Councilmember Dehen stated that if we have staff do something, he would want <br />Councilmember Look's :concern addressed. He wanted a legal opinion on that -the <br />constitutionality of the City requiring inspections. <br />It was noted that a couple of things to keep in mind is that the inspection should not be <br />done without the tenant's okay to enter the premises and that inspections cannot be done <br />for trivial things. <br />Building Official Kaehler cautioned that the way some of these people are using these <br />units are a terrible fire hazard. <br />Councilmember Look felt that the only option is to educate the people. <br />City Administrator Ulrich clarified single family versus multi-family - to note the <br />distinction between the two. <br />Councilmember McGlone reiterated eliminating the licensing program. <br />Mayor Ramsey stated he would agree but you cannot have a permit if you are. not going <br />to do an inspection. <br />Councilmember Dehen stated it appears there is a consensus to eliminate this process but <br />there may be some benefit to having staff look at it again and bring something back. <br />There was -also discussion about having a pamphlet available for people to receive <br />information to explain what their rights as tenants -are. <br />Deputy City Administrator Nelson stated that, with regard to contracting building <br />inspections, the City received five submittals and interviewed three firms. We have seen <br />an increase in building activity - we will have ebb and flow and the Town Center will <br />add to that activity level. We want to make sure Council is aware of the final significant <br />costs with the layoffs, etc. <br />Mayor Ramsey stated that we had a conversation about what is required for inspections <br />and because we adopt the Uniform Building Code, we have to follow that. We wanted to <br />get an interpretation of if that's the fact or not. <br />It was noted that in 2008, the City adopted the Uniform Building Code by State Statutes <br />and we cannot repeal that. <br />Building Official Kaehler reported that the State was mandated to do a Code in the <br />1970's. The seven-county metro area was mandated to adopt that Code. <br />Mayor Ramsey stated we have no options - we have to issue permits and do inspections. <br />City Council Work Session -December 1, 2009 <br />Page 11 of 16 <br />
