TO: City Administrator

FROM: City Attorney

RE: Status Report on Assigned Projects

DATE: January 7, 1981

1)

Highway #47 - County Road #5 Right-Of-Way Acquisition by State Highway
Department:

'.

The County examined the required abstracts and issued a title oplnlon.
I forwarded to the County the deeds we obtained from First Guarantee
and the County is still reviewing this information and as of this date
the County Attorney's office says it will advise us shortly of final
documents needed so that a closing can proceed.

2)

Nugent Pig Farm:

Presently, the Nugents have all their cows and pigs on their home place
west of Ford Brook. By telephone on December 17, 1980 and again on
January 5, 1981, Mrs. Nugent advised me that they were holding an auction
on January 12, 1981 at which time all live stock would be sold and re-
moved from the site.

3) Anoka/Ramsey Landfill Contract:

.

I have obtained an affidavit from Don Scarborough and spoken with both
Joe Chutich and Ruth Franklin. These are the former Council persons
from Anoka who voted "yes" on the above contract in 1976. All three
individuals are very positive in their statements to me to the effect
that they knew the significance of the contract and that they intended
passage of an ordinance to be merely proceedural in order to transfer
title to the land and if necessary they will state so in Court.

r

I have also about completed the legal research required on the contract
validity. I would like the Council's thoughts on whether or not you
believe it would be tactically wise to forward my research analysis and
affidavits from the three former Anoka Council persons to Anoka in
attempt to convince Anoka that it is wrong in taking the position it
has on this issue.

4) Federal Cartridge Park Land Donation:

On January 7, 1981, Clayton Scott advised me that the Federal Cartridge
Board of Directors had approved donating the approximately 50 acres of
land west of Variolite and north of l61st to the City of Ramsey.
