Councilmember McGlone introduced the following resolution and moved for its adoption: <br />RESOLUTION #10 -01 -030 <br />A RESOLUTION ADOPTING FINDING OF FACT #0860 RELATING TO A REQUEST <br />FROM MICHAEL BUCKMAN FOR A CONDITIONAL USE PERMIT FOR A <br />PRIVATE DOG KENNEL TO MAINTAIN FOUR OR MORE DOGS ON A PARCEL OF <br />PROPERTY. <br />WHEREAS, the City of Ramsey received an application from Michael Buckman for a <br />conditional use permit to maintain more than three dogs on the property generally known as <br />15916 St. Francis Blvd. NW, and legally described as follows: <br />That part of the northeast quarter of the southeast quarter lying southerly of the <br />south line of the plat of Hall- Anderson Acres, Anoka County, Minnesota; westerly <br />of the westerly right of way line of St. Francis Blvd. (AKA T H No 47) and <br />northerly and westerly of the following described line, commencing at the <br />southwest corner of said Quarter Quarter, thence east along the south line thereof 10 <br />feet to the point of beginning of line to be described, thence north and parallel with <br />the west line of said Quarter Quarter,120 feet, thence east and parallel with the <br />south line of said Quarter Quarter to the intersection with the westerly right ot4way <br />line of St. Francis Blvd. NW (AKA T H No. 47) and there terminate except roads <br />subject to easement of record <br />(the "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That City Code Section 5.03.09 allows a maximum of three dogs per parcel. <br />2. That Section 5.09.03 of the Ramsey City Code defines private dog kennels as any place <br />where four or more dogs over six (6) months of age on property occupied by the dog owner <br />for residential purposes and where the keeping of such dogs is incidental to the occupancy of <br />the premises, and may include breeding and selling dogs as a hobby. <br />3. That private kennels are a conditional use per City Code Section 9.20.11. <br />4. That on November 2, 2009, Michael Buckman, hereinafter referred to as "the Applicant," <br />properly applied for a conditional use permit for a private dog kennel to maintain four or <br />more dogs on the Subject Property. <br />5. That the Applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on December 3, 2009, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />
