<br />Councilmember Dehen agreed and stated concern that this question even came before the <br />Council when the ordinance language is clear there is no provision to waive the fee. <br /> <br />Community Development Director Miller explained the request was made to waive the fee. <br />Since staff does not have the authority to make this determination, its only recourse is to present <br />the request to the Council. <br /> <br />Councilmember Dehen stated when the City undertakes an enforcement action, staff needs to <br />make sure there is no ambiguity in the ordinance language so issues don't come up. He stated <br />the City Attorney can determine if there is ambiguity and encouraged staff to check with legal <br />counsel. <br /> <br />Environmental Coordinator Anderson stated staff has had discussions with the City Attorney and <br />Chief of Police on this matter and regardless of the property involved, staff would follow up on it <br />should a compliant be received. He noted the request to waive the fee is on the Council's agenda <br />for consideration tonight. <br /> <br />Council consensus was reached to not consider waiving fee. <br /> <br />4) Update on Armstrong Boulevard and TH 10 Interchange <br /> <br />City Engineer Himmer reviewed staff s report. <br /> <br />Tony Heppelmann, WSB, presented updated information on the regional roadway improvement <br />associated with the Ramsey Town Center and the upgrade of Armstrong Boulevard at TH 10 that <br />would be presented at the February 17,2010 public open house. <br /> <br />Councilmember Jeffrey arrived at 6:45 p.m. <br /> <br />Mayor Ramsey noted that sometimes after a train goes by, you have to wait double the normal <br />time for the turn signal light. He asked if MnDOT can better time the lights. <br /> <br />Mr. Lindberg explained that after a train goes through, the signals try to get back into sync with <br />other lights on Highway 10. <br /> <br />Councilmember Elvig asked about the indication there are no plans for a river crossing. He <br />pointed out this river crossing is in the Metropolitan Council planning and the Ramsey and <br />Dayton Comprehensive Plans have an overlay so the planning is in place. In addition, Mark <br />Kennedy brought in $900,000 for the initial research. <br /> <br />Mr. Heppelmann stated they did not want this to become a river crossing study instead of an <br />Armstrong Boulevard Study. He stated they have copies of the drawings but there is no <br />approved plan, money in place, or specific timeframe for a bridge crossing. <br /> <br />Informational; no action required. <br /> <br />City Council Work Session / February 9, 2010 <br />Page 6 of7 <br />
