CASE # 9 <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW MOTOR <br />VEHICLE REPAIRS AND MOTOR VEHICLE SALES IN THE H -1 HIGHWAY 10 <br />BUSINESS DISTRICT ON THE PROPERTY LOCATED AT 6845 HIGHWAY 10 NW; <br />CASE OF EDDY'S AUTO & BODY REPAIR, INC. <br />By: Chris Anderson, Environmental Coordinator <br />Background: <br />Eddy's Auto & Body Repair, Inc. is seeking to relocate its operation from Andover into the <br />building located at 6845 Highway 10 NW. The site is zoned H -1 Highway 10 Business District, <br />which now requires a Conditional Use Permit to conduct motor vehicle repairs and sales. <br />Notification: <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br />Observations: <br />Eddy's Auto & Body Repair, Inc. is looking to move its auto and body repair operation to the <br />property at 6845 Highway 10 NW, which is the former site of City Wide Garage Door. The <br />Applicant is in discussion with the current property owner to purchase this property. The <br />business currently has six (6) full time employees and the hours of operation would be Monday <br />through Friday from 8 a.m. to 6 p.m. and Saturdays from 8 a.m. to 12 p.m. <br />In October of 2009, City Code was amended to shift motor vehicle, implement and recreation <br />equipment sales and service from a permitted use to a conditional use in both the B -2 Business <br />and the H -1 Highway 10 Business Districts. Since motor vehicle repair was not occurring on the <br />site at the time of the code amendment, nor had it been within the past twelve (12) months, a <br />Conditional Use Permit is now required. <br />There are essentially four components of the building. The Applicant intends to use the (1) <br />southern most portion of the building as office space, the (2) middle, long north -south section of <br />the building for auto repair, the (3) northern portion of the building for the body shop, and hopes <br />to lease out the (4) western portion, which is additional office /showroom space. <br />The majority of the site is paved; however, the parking area(s) was never striped. Per City Code <br />§117 -356, the required parking for this new use is determined by the following: three (3) parking <br />spaces for each enclosed bay, one parking space for each full time employee, one parking space <br />for every 300 square feet of office space, and one parking space for every ten (10) motor vehicles <br />displayed for sale. There is a combined total of 5,070 square feet of office space, six (6) bays <br />and six (6) full time employees. Therefore, the Applicant will be required to provide and stripe <br />at least forty -one (41) parking spaces. One additional striped parking space for every ten (10) <br />vehicles on display will also be required. <br />
