Due to the change in use, there will be some required building modifications. These <br />modifications are necessary to ensure that the building complies with all applicable building, fire <br />and plumbing codes. The Applicant will be required to obtain any and all necessary permits for <br />the required modifications. <br />While most of the mechanical repairs will be completed on the same day, the Applicant has <br />stated that in certain instances, some of the auto body repairs may take multiple days to complete, <br />depending on parts availability. The Applicant has stated that he hopes to store these vehicles <br />indoors, but from time to time they may need to be parked outside on the property until parts are <br />available and the repairs can be completed. In that case, the vehicles would be stored just north <br />of the western office /showroom space. The vehicles would be screened by the building on the <br />west and south sides and screening that is 100% opaque will have to be installed on the west and <br />north sides. Furthermore, this area will need to be surfaced with bituminous or concrete to <br />comply with City Code. <br />There is an existing tenant on the site that is conducting motor vehicle sales currently. Since this <br />use was occurring on the site when City Code was amended to require a Conditional Use Permit <br />for motor vehicle sales and repair, it is considered a lawful nonconforming use. The Applicant <br />has stated that this tenant is likely to continue operating on the site. Therefore, the Conditional <br />Use Permit, if approved, includes motor vehicle sales in addition to motor vehicle repairs. <br />The Planning Commission conducted a public hearing on March 4, 2010 regarding this request. <br />There were no verbal or written comments submitted at the hearing. <br />Recommendation: <br />The Planning Commission and Staff are recommending approval of the Conditional Use Permit <br />request, contingent upon the following: <br />1. Applicant shall stripe the required parking stalls (a minimum of forty-one [41]). <br />2. Any motor vehicle awaiting repairs that cannot be completed on the same day the vehicle <br />is brought on site shall be stored either indoors or in the designated area identified on <br />Exhibit 1 on a bituminous or concrete surface and screened on all sides with 100% <br />opaque screening of wood, masonry or maintenance free material. Chain link fencing of <br />any type for screening purposes will is not permitted. <br />3. Any motor vehicle awaiting repairs shall not be stored outside on the site for more than <br />fourteen (14) days unless a written request for an extension for up to thirty (30) days more <br />is approved by the Zoning Administrator. Any extension beyond that would require City <br />Council authorization. <br />4. There is no salvaging of parts from inoperable vehicles on site to be used to repair other <br />motor vehicles. <br />Funding Source: <br />All costs associated with processing the application are the responsibility of the applicant. <br />
