MEMO <br />To: City Council <br />From: Tim Gladhill, Associate Planner <br />Date: April 7, 2010 <br />RE: Request for extension to expiration of Variance <br />Background: <br />On September 4, 2008, the City's Board of Adjustment approved a Variance to sidewall height <br />restrictions in the R -1 Residential (MUSA) District for parcels less than two (2) acres in size. The <br />Permit stated that the Variance shall be initiated by September 4, 2009 and that issuance of a <br />Building Permit constituted initiation of the Variance. On August 21, 2009, the City received an <br />application for a Building Permit. The City attempted to contact the Permittee on August 25, 2009, <br />but the call was never returned. The timeframe to initiate the Variance thus lapsed. <br />On or about March 13, 2010, the City was contacted by the Permittee inquiring about the Permit <br />and whether it was still valid. In researching the request, it was discovered that the Variance was <br />technically void due to expiration. It is Staffs understanding in speaking with the Permittee over <br />the phone is that the Perrnittee did not plan on constructing the accessory structure within <br />approximately three months of the application for Building Permit (essentially did not plan on <br />construction until at least spring). The Permittee's response is attached for your review. <br />By approving this item, City Staff will issue the Building Permit per the terms of the approved <br />Variance. <br />Action Statement: <br />Motion to extend expiration date of the Variance, thereby authorizing Staff to issue Building <br />Permit. <br />Reviewed by: <br />City Administrator /'".. <br />Planning Manager <br />CC: 04/13/2010 <br />Attachments: <br />A) Request from Permittee <br />B) Notification to Permittee <br />C) Copy of Building Permit Cover Sheet <br />X09 <br />
