Councilmember introduced the following resolution and moved for its <br />adoption: <br />#10- 04 -XXX <br />RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN PROPERTY NECESSARY <br />FOR THE EXTENSION OF 152 AVENUE TO HELIUM STREET <br />WHEREAS, the City finds it necessary and in the public interest to connect 152 Avenue <br />westward to serve the public transportation needs of the City's residents (the "Public Improvement <br />Project "); and <br />WHEREAS, the Public Improvement Project is identified on the City's master municipal <br />transportation plan as a means of eliminating dirt streets; and <br />WHEREAS, the City has obtained appraisals from a certified professional appraiser for the <br />acquisition of three parcels necessary for this roadway connection and IP 08 -34, the Bituminous Paving <br />of 151 Ave, 152 Ave. and Fluorine Street, consistent with the feasibility study for this project; and <br />WHEREAS, it is necessary to acquire fee title to certain parcels; and <br />WHEREAS, the legal descriptions of the properties to be acquired in fee title are attached as <br />Exhibit A: <br />WHEREAS, the City declares that it is in the public interest to acquire the Required Properties <br />described above; and <br />WHEREAS, the City has authority to acquire the Required Properties for the Public <br />Improvement Project by eminent domain pursuant to Minn. Stat. Chapter 117; and <br />WHEREAS, the City has the right to acquire title and possession of the Required Properties <br />prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stat. §117.001 <br />and §117.042; and <br />WHEREAS, the City finds and declares that it is in the public interest to acquire title to and <br />possession of the Required Properties prior to the filing of an award by the Court Appointed <br />Commissioners; and <br />WHEREAS, the property owner of the Required Properties and the Anoka County PIN for the <br />said Property Interests have been identified by the City as follows: <br />RESOLUTION #10- 04 -XXX <br />Page 1 of 3 <br />
