That in order to carry out the purposes and objectives described above it is necessary to acquire <br />the Required Properties. <br />2. The acquisition of the Required Properties by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br />3. The City deems it necessary for the reasons set forth above to proceed without delay under Minn. <br />Stat. §117.042 to pay to the owners or into court a sum of money to serve as compensation to the <br />owner of the Required Properties, which amount shall be equal to Petitioner's approved appraisal <br />of value as determined by the City. <br />4. That the City Administrator is hereby directed to acquire the Required Properties as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate <br />and represent the City of Ramsey in all proceedings. <br />5. That if the Required Properties cannot be acquired by direct negotiation, they shall be acquired <br />by eminent domain. <br />6. That the City Council hereby authorizes acquisition of the Required Properties by eminent <br />domain and to take title and possession of that land prior to filing of an award by the Court <br />Appointed Commissioners pursuant to Minn. Stat. §117.011 and §117.042. <br />7. That the City Attorney is authorized to file the necessary petition therefore, and to prosecute such <br />action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or <br />Court. <br />8. The City Administrator is authorized to expend necessary funds for appraisals of the Required <br />Properties, if necessary. <br />The motion of the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following in favor thereof: <br />and the following voted against the same: <br />RESOLUTION #10- 04 -XXX <br />Page 2 of 3 <br />
