LRRWMO Meeting Minutes <br />May 18, 1988 <br />Page 2 <br />CONSIDERATION OF COMMUNICATIONS <br />Chairman Schrantz reported receiving a copy of a 5 -4 -88 letter from <br />Curtis Pearson, Attorney for the LRRWMO, directed to Lund and Koehler, <br />229 Jackson St., Suite 105, Anoka, with regard to reports of pending or <br />threatened litigation, claims, assessments, unasserted claims, or un- <br />asserted assessments made against the LRRWMO. Mr. Pearson's response <br />was that to the best of his knowledge there were no such actions; there- <br />fore, nothing to report. <br />A 4 -25 -88 letter was received from the Mn /DNR approving permit <br />extension #84 -6186, retaining wall, Rum River, for John Underwood, 3620 <br />Run River Drive, Anoka, to expire 5- 31 -89. No action. File only. <br />A memorandum dated 5 -5 -88 was received from the Minnesota Board of <br />Water and Soil Resources discussing the plan review, their policies and <br />procedures. <br />OLD BUSINESS <br />1._ WMO Liability Insurance - Mr. Weaver, having agreed to further <br />research the potential need for WMO liability insurance, reported having <br />called legal counsel Curtis Pearson. It was reported that some time ago <br />this WMO passed a resolution assuring that members would be defended by <br />the board should a law suit take place because of particular actions or <br />omissions. It was found that having taken such action, members could <br />look to their member boards to extend their protection as representatives <br />of that community. It was Mr. Weaver's opinion that this WMO board does <br />not need liability insurance. <br />Mr. Raatikka reminded members that the Ramsey City Council wanted this <br />board to insure itself, and had, therefore, voted no on the aforementioned <br />resolution, as per Ramsey Council directive. <br />Mr. Pearson again reviewed the provisions of the approved resolution. <br />He stated that this board could indeed purchase insurance which would allow <br />for legal defense in case of a law suit, but the insurance company would <br />not pay anything in terms of a settlement. It was Mr. Pearson's position <br />that this WMO is adequately protected at the moment. <br />Motion was made by Mr. Weaver, seconded for discussion by Chairman <br />Schrantz, to table discussion of liability insurance to an undetermined <br />future date. Upon voice vote Mr. Weaver, Chairman Schrantz, and Mr. Mathisen <br />voted yes; Mr. Raatikka voted no. Motion carried. <br />2. Water Management Plan - The review process for the Water Manage- <br />ment Plan was discussed. Mr. Pearson provided a draft resolution which <br />would initiate the process upon WMO approval. <br />Motion was made by Mr. Weaver, seconded by Mr. Raatikka, to adopt <br />Resolution #88 -1, initiating the review process of the Lower Rum River <br />Water Management Plan. <br />
