Motion Erickson queried whether this board has the authority to make the requests presented in the motion without an established plan. Weaver stated this board has not only the authority but the responsibility to attempt to protect the quality of water. Schrantz noted the 509 legislation specifically spells out the WMO responsibilities and authority. CONSIDERATION OF COMMUNICATIONS Skallman presented two letters received from the DNR: 1. October 2, 1990, letter referencing permit #90 -6306, 153rd Avenue, roadfill and mitigation, protected wetlands 2- 114P, 2 -656W and 2 -657W, City of Ramsey, Anoka County. Raatikka explained it is a permit to build a road. No action taken. 2. October 10, 1990, letter addressing an unauthorized retaining wall, V91 -6027, Mississippi River (Mile 871), City of Anoka, Hennepin County. Said letter, addressed to Thomas F. Micka, 1160 Benton Street, Anoka, indicates he constructed a retaining wall on his property with some of the work taking place below the ordinary high water elevation of the Mississippi River with no valid DNR permit authorizing the work. Schultz reported the DNR has given Mr. Micka the option of applying for an After the Fact permit or else removing the retaining wall. Schultz was under the impres- sion Mr. Micka has applied for the After the Fact permit. No action taken. OLD BUSINESS - (Cont.) Alternative Permitting Procedure Members continued to discuss the permitting procedure. Raatikka reported the Ramsey City Council has voted to retain the local review process rather than creating more work for the LRRWMO. Jankowski indicated Ramsey City Council was quite adamant about maintaining local control and queried why Anoka changed its position. Weaver explained Anoka's altered stand on this issue resulted from attorney Curtis Pearson's July 23, 1990, which very clearly outlines the LRRWMO's statutory responsibilities. Following discussion, Skallman agreed to redraft the permit application for construction to reflect the board's changes.
