Motion <br />Erickson queried whether this board has the authority to make <br />the requests presented in the motion without an established <br />plan. Weaver stated this board has not only the authority <br />but the responsibility to attempt to protect the quality of <br />water. Schrantz noted the 509 legislation specifically <br />spells out the WMO responsibilities and authority. <br />CONSIDERATION OF COMMUNICATIONS <br />Skallman presented two letters received from the DNR: <br />1. October 2, 1990, letter referencing permit #90 -6306, <br />153rd Avenue, roadfill and mitigation, protected wetlands 2- <br />114P, 2 -656W and 2 -657W, City of Ramsey, Anoka County. <br />Raatikka explained it is a permit to build a road. No action <br />taken. <br />2. October 10, 1990, letter addressing an unauthorized <br />retaining wall, V91 -6027, Mississippi River (Mile 871), City <br />of Anoka, Hennepin County. Said letter, addressed to Thomas <br />F. Micka, 1160 Benton Street, Anoka, indicates he constructed <br />a retaining wall on his property with some of the work taking <br />place below the ordinary high water elevation of the <br />Mississippi River with no valid DNR permit authorizing the <br />work. Schultz reported the DNR has given Mr. Micka the <br />option of applying for an After the Fact permit or else <br />removing the retaining wall. Schultz was under the impres- <br />sion Mr. Micka has applied for the After the Fact permit. No <br />action taken. <br />OLD BUSINESS - (Cont.) <br />Alternative Permitting Procedure <br />Members continued to discuss the permitting procedure. <br />Raatikka reported the Ramsey City Council has voted to retain <br />the local review process rather than creating more work for <br />the LRRWMO. Jankowski indicated Ramsey City Council was <br />quite adamant about maintaining local control and queried why <br />Anoka changed its position. <br />Weaver explained Anoka's altered stand on this issue resulted <br />from attorney Curtis Pearson's July 23, 1990, which very <br />clearly outlines the LRRWMO's statutory responsibilities. <br />Following discussion, Skallman agreed to redraft the permit <br />application for construction to reflect the board's changes. <br />
