Said <br />order was reviewed by the board. The board agreed the LRRWMO <br />is considered the enforcement agency for said restoration, <br />and the DNR has agreed to issue said order to the appropriate <br />party. <br />Jankowski noted the restoration order is requiring the <br />homeowner at 17540 St. Francis Boulevard to remove the <br />material from the wetland and to hire someone to identify the <br />extent of where the wetland was previous to the filling and <br />to remove that material also. Jankowski indicated this order <br />states this order is final and binding unless he asks the <br />LRRWMO for an exemption or replacement agreement. <br />Motion was made by Jankowski, seconded by Ottensman, to <br />AUTHORIZE THE LRRWMO CHAIRMAN TO SIGN THIS LETTER DIRECTING <br />THE DNR TO ISSUE THIS RESTORATION ORDER. <br />4 ayes - 0 nayes. Motion carried. <br />2700 block of Constance Boulevard (County Road 20) one -half <br />on the north s <br />Jankowski indicated this identified property is located in <br />Andover. Schrantz concurred, adding that this individual had <br />a permit last year from the Corps of Engineers, so it would <br />be exempt. Although the individual is using the wrong size <br />pipe. He should probably be using a 36 -inch rather than the <br />15 -inch pipe. However, the need for a restoration order was <br />solved with the exemption. <br />Jankowski noted, however, that another wetland in Ramsey, <br />known as Sunny Pond, previous named Fletcher's Second <br />Addition, has been affected. This subdivision received <br />preliminary approval May 26, 1992, and he asked that the <br />board consider this for exemption from the 1991 Wetland <br />Conservation Act. <br />Jankowski stated the DNR defines protected wetlands as being <br />in the 860 contour. In addition, the surveyor identified <br />this lot as Type 2 wetland detached from it but defined as <br />within the 860 contour. He went on to state that during the <br />course of grading, the developer placed material beyond the <br />860 of the protected wetland in the two locations indicated <br />on the map provided. Jankowski stated they met with the DNR <br />regarding this and the material to be removed and determined <br />the wetland should be restored back to the 860 contour. <br />Jankowski indicated he reviewed the Wetland Protection Act to <br />see if an exception would apply to this situation regarding <br />
