5 � <br />LRRWMO Special Meeting Minutes <br />July 22, 1992 <br />Page 2 <br />Person could, at the August meeting, provide an update on <br />water policies. <br />Erickson recalled that the LRRWMO was holding off on having <br />its Joint Powers Agreement updated until the Minnesota Board <br />of Water and Soil Resources (BWSR) comes up with its new <br />rules. Schrantz felt those BWSR rules will be a second <br />generation plan and will not be due until 1995. That should <br />not involve our Joint Powers Agreement. Schrantz suggested <br />the board discuss this with Pearson in August. <br />Motion was made by Weaver, seconded for discussion by <br />Jankowski, to INVITE ATTORNEY CURTIS PEARSON TO THE LRRWMO'S <br />NEXT MEETING. PRIOR TO THAT MEETING THE LEGAL CONSULTANT <br />SHALL REVIEW AND PROVIDE AN UPDATED JOINT POWERS AGREEMENT <br />AND AN UPDATED PROPOSED CONTRACT FOR ENGINEERING SERVICES AND <br />ANY OTHER DOCUMENTS THAT IS RELEVANT TO OUR IMMEDIATE WORK <br />AND IN THE NEAR FUTURE. (See the amendment to the motion <br />later in discussion.) <br />Jankowski agreed with the need for the preparation of a Joint <br />Powers Agreement but indicated he was not sure that the <br />engineering contract needed to be prepared by an attorney. <br />He suggested, with regard to the engineering contract, that <br />requests be taken for qualifications from some of the firms <br />capable of providing engineering services; then, upon <br />interviewing them, ask for a proposed contract. Jankowski <br />suggested letting the engineering firm do the ground work; <br />the LRRWMO can review and modify the firm's proposed contract <br />as we want. <br />Schrantz felt we should not advertise at this point in time. <br />He suggested obtaining a proposed contract for engineering <br />services from Barr Engineering and others, review them all, <br />and send them to our attorney to put together. <br />Weaver directed that the motion be amended, agreed upon by <br />Jankowski, to ASK THE LRRWMO LEGAL COUNSEL TO WORK ON AN <br />UPDATED JOINT POWERS AGREEMENT, TO PROVIDE SAMPLES OF AN <br />ENGINEERING CONSULTING SERVICES CONTRACT, AND, FURTHER, TO <br />PROVIDE AN UPDATE ON WATER MANAGEMENT ISSUES FROM THE <br />ATTORNEY'S PERSPECTIVE AS OUR LEGAL COUNSEL. THE LRRWMO <br />ATTORNEY SHALL FIRST PROVIDE THE BOARD WITH A PRICE QUOTE FOR <br />HIS SERVICES IN UPDATING THE JOINT POWERS AGREEMENT, ALONG <br />WITH THE COSTS FOR HIS SERVICES IN UPDATING THE CONSULTING <br />ENGINEERING CONTRACT. <br />4 ayes - 0 nayes.
