As eluded to earlier, staff feels that by simply repealing the sections of City Code that contradict the <br />ability of the property owner.to replace and/or repair their noncompliant private system, and make it <br />consistent with the City Charter should resolve this matter. <br />Funding Source: <br />City Code amendments are processed with Staff time. <br />Recommendation: <br />Staff recommends that the following sections of City Code, related to municipal utility connections, be <br />repealed: <br />• Section S$-110 (c) <br />• Section 58-141 (c) <br />• Section 58-141 (d) <br />Action: <br />Motion to introduce Ordinance 10-XXX repealing the following sections of City Code, which clarify the <br />intent of municipal utility connections and maintain consistency with City Charter. <br />• Section 58-110 (c) <br />• Section 58-141 (c) <br />• Section 58-141 (d) <br />-or- <br />1vlotion to approve resolution 10-04-XXX, requesting the Charter Commission to review the existing <br />language of Section $.6.1 related to municipal utility connections. <br />-and- <br />Motion to deny Ordinance 10-XXX, repealing the associated sections of City Code. <br />Attachments: <br />Ordinance 10-XXX <br />Resolution 10-04-XXX <br />Reviewed By: <br />City Administrator ' <br />Director of Public Works/Principal City Engineer <br />Building Official <br />CC: 4/13/10 <br />
