CASE # <br />CONSIDER REQUEST FOR SPECIAL EVENTS PERMIT; <br />CASE OF THE PENALTY BOX BAR & GRILL <br />By: Jo Thieling, City Clerk <br />Preface: This request was originally placed on the Consent Agenda for this evening under <br />"Approve Licenses". City Administrator Ulrich has asked staff to write a case for this request <br />and add it to the regular portion of the agenda to provide Council more information. <br />Background: <br />Shawn McManus has applied for a special events permit to hold a tent party in the parking lot of <br />his establishment, The Penalty Box Sports Bar & Grill, located at 14077 St. Francis Boulevard <br />NW. The event, which will include live music, is scheduled for Friday, May 7, beginning at 7:00 <br />p.m. (band to start at 8:00 p.m.) and Saturday, May 8, beginning at noon with the band to again <br />start at 8:00 p.m. Mr. McManus is also requesting the bands be allowed to play until midnight. <br />City Code requires them to shut down at 11:00 p.m., however, Council may grant a later time if <br />they choose. During the last event (August 2009), Council allowed the bands to play until <br />midnight but directed that the volume be turned down at 11:00 p.m. A Ramsey officer <br />physically checked the volume at 10:30 and again at 11:00 to make certain Mr. McManus <br />complied with that directive; Mr. McManus was in compliance. Chief Way has reported that <br />there were no noise complaints received. <br />An addition to this year's event is that Mr. McManus is bringing in a big screen for the Twins <br />game on Saturday afternoon. Some of the proceeds from the afternoon event will be donated to <br />St. Jude's hospital. <br />Staff met with Mr. McManus on Monday afternoon. Present at the meeting were Police Chief <br />Jim Way, Fire Chief Dean Kapler and City Clerk Jo Thieling. Following is what was discussed: <br />1) Location of the Tent: Chief Kapler felt that having the tent closer to the building, as <br />was done at the August event, eliminating a drive lane between the tent and The Penalty <br />Box building, was a much safer location. Mr. McManus agreed to that location. <br />2) Parking Spaces: Staff again offered the use of the "old Amoco site" and the "sledding <br />hill" site for parking spaces providing Mr. McManus would take care of the mowing of it <br />prior to the event and the clean-up following the event. Mr. McManus agreed. There is <br />not a fee for use of the parking site. City Attorney Goodrich will again write up an <br />indemnification agreement with regard to the use of City property. Mr. McManus shall <br />sign such indemnification agreement as prepared. <br />3) Notification of Neighboring Tenants: When Mr. McManus' first event was held in <br />May 2009, some of the neighboring tenants expressed some concerns -mainly about <br />parking spaces. When Mr. McManus held his event in September, he notified all of those <br />tenants in writing and had them sign off on the notification. Mr. McManus presented <br />those signatures to the Council. Chief Way has requested Mr. McManus shall notify all <br />neighboring tenants and present the signatures to staff by Friday afternoon, April 30. Mr. <br />
