Mayor Gamec replied that they as a Council don't get involved with towing cars, the person he
should be talking to is Chief Way.

Mr. Bouten stated that the request for proposal deadline is coming up soon and he is in
disagreement with the request. He noted that there are a couple of other companies that are
interested in the contract, and they are located outside the City of Ramsey.

Mayor Gamec i'eplied that Mr. Bouten should be dealing with the Police-Deparlrnent on the issue
because the Police Department put the proposal together.

Mr. Bouten stated that he thought the Council made the final decision.

Mayor Gamec replied that that was correct.

Mr. Bouten inquired if ~he Council educated themselves on the issuel

Councilmembers responded that they did want to review the request for Proposal.

City Attorney Goodrich advised Mr. Bouten to submit his proposaI and to inctude in his proposal
what he is in disagreement with. At the present time, the Council does not have the information
before them, but when the proposals are reviewed by the Council, Mr. Bouten will have an
opportunity to speak.

Mr. Bouten stated that he can educate the Council on how towing works. He explained that the
proposal was designed for Maple Grove to remove a guy who purchased a tow truck who thought
he could handle the City's towing.

Councilmember Kurak stated that she thought when a committee makes a recommendation to go
out for a request for proposal it would still have to come before the Council for authorization..

City Attorney Goodrich noted that the issue was on a previous City Council consent agenda. He
noted that no decision has been made at this point other than requesting proposals.

Councilmember Elvig stated that when the Councilmembers have the paperwork they would
probably have their own questions.

Mr. Bouten requested that the Council table the due date until the Council has time to review the
request for proposal document. :

Mayor Gamec replied that the Council woUld be the one making the final decisiOn on the
contract.
City Attorney Goodrich advised that it would notbe appropriate for the Council to.table the due
date because other people have been notified of that date. He noted that just because the City has
requested proposals does not mean that the Council has to change anything.

Mayor Gamec informed Mr. Bouten that he would be ~ven an opportunity to speak about the
proposal when the case is presented to the City Council.

City Council/March 11, 2003

-129-
