I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Case #4 <br /> <br />Request to Rezone Property from R-1 Single Family Residential to Planned <br />Unit Development <br /> <br />A motion was made by Commissioner Johnson, seconded by Chairperson 'Nixt to adopt the <br />Findings of Fact favorable to approval for the request to rezone property fi'om R-1 Single Family <br />Residential to Planned Unit Development. <br /> <br />Commissioner Johnson stated that he likes the development, and he believes that homebuyers <br />will like it, as there are people who will want smaller yard sizes to maintain. <br /> <br />Chairperson Nixt asked if the Commission should tie this to the final plat plan. ' <br /> <br />Commissioner Johnson_suggested they leave that to the City Council. <br /> <br />Commissioner Brauer stated he was a little uncomfortable, and not sure of the language reflected. <br />in the Resolution. <br /> <br />Chairperson Nixt recommended adding wording to paragraph 22 stating 'has deviations <br />substantially in accordance with the plan shown on page 38. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Reeve and Shepherd. <br />Voting No: Commissioners Brauer and Van Scoy. Absent: None. Commissioner Watson <br />abstained. <br /> <br />Case #5 <br /> <br />Request fo r Preliminary Plat Review of Village of Sunfish Lake <br /> <br />A motion was made by Commissioner Johnson to recommend to <br />preliminary plat by approved, contingent upon the following items: <br /> · Compliance with City Staff review letter <br /> <br />the City Council the <br /> <br />Principal Planner Trudgeon stated he wanted to point out the City Council took a close look at <br />the connections and felt they should remain. <br /> <br />Chairperson Nixt indicated that what was discussed is it makes no sense to run the road' to where <br />it is at if it will be closed, and he would like to see a cul-de-sac there. He clarified he was talking <br />about the 146th connection. <br /> <br />Commissioner Brauer asked if the determination had been for 28-foot street widths. <br /> <br />Commissioner Johnson stated that to come to closure here, he would go with 28 feet. <br /> <br />Chairperson Nixt stated that if you go to 28 feet, you are increasing the deviation of the setbacks. <br /> <br />Planning Commission/February 6, 2003 <br /> Page 19 of 26 <br /> <br />-39- <br /> <br /> <br />
